Harvest Share Use. Section 7.2 is administrative except to the extent that it applies to the 17 Sector managers ability to impose and utilize legal means to recover Liquated damages as 18 authorized in section §10.10 of this agreement, in which case NMFS enforcement procedures 19 may apply.

Harvest Share Use. Only Members that notify the Manager in writing on or 24 before [INSERT DATE] (the “Notification Date”), and on or before any succeeding Notification Dates 25 established by the Board for FY 2017 and FY 2018 thereafter of their intention to harvest Sector ACE
Harvest Share Use. Only Members that notify the Manager in writing on or before December 31, 2009 (the “Notification Date”), and on or before succeeding Notification Dates established by the Board for 2010 and thereafter of their intention to harvest Sector ACE (“Active Members”) may harvest Sector ACE. Each Member’s notice that such Member intends to harvest Sector ACE shall identify the vessels which will be used for such harvest. Non‐active Members shall not harvest Sector ACE, including without limitation, their own Harvest Share. No Active Member shall harvest an amount of Sector ACE in excess of their Harvest Share. Harvest of each Member's Harvest Share shall be subject to all NMFS and other management regulations generally applicable to the Sector’s ACE (including but not limited to seasonal apportionments and area harvest restrictions) on a discreet, individual basis; i.e., no greater percentage of each Member's Harvest Share may be harvested in any season or area than the percentage of the related Sector ACE allocation permitted to be harvested in such season or area. The Manager may impose and enforce additional restrictions on each Active Member’s harvest of Sector ACE authorized by this Agreement or adopted by the Board.
Harvest Share Use. This Sector is comprised of non-active Members only, 10 who shall not harvest Sector ACE, including without limitation, their own Harvest Share. Members may 11 transfer (lease) harvest share between members and the sector manager will execute transfers of sector 12 ACE through inter-sector leasing.

  • Compensatory Time Use An employee must use compensatory time prior to using vacation leave, unless this would result in the loss of their vacation leave or the employee is using vacation leave for domestic violence leave. Compensatory time must be used and scheduled in the same manner as vacation leave, as in Article 11, Vacation Leave. Employees may use compensatory time for leave as required by the Domestic Violence Leave Act, RCW 49.76. The Employer may schedule an employee to use their compensatory time with seven (7) calendar days’ notice.
