Guaranties and Warranties. Operator acknowledges receipt of copies of all guaranties and warranties relating to the Project in City's possession or control. Operator shall see that all work done to or in the DPAC that is the Operator's responsibility includes obtaining guaranties and warranties that are consistent with industry standards and shall use all reasonable efforts to enforce all such guaranties or warranties. City shall cooperate with Operator in such efforts. During the guaranty or warranty period, Operator shall maintain equipment in accordance with the terms of the guaranty or warranty including, if necessary, the negotiation, execution and administration of maintenance contracts as set forth in Section 4.6.10 below. Operator shall see that all guaranties, warranties, service contracts, and licenses for which it is responsible pursuant to this Section 4.6.9 are placed in the name of the City, or if placed in the name of the Operator, are assignable to the City.

Guaranties and Warranties. Other than endorsements of negotiable instruments in the ordinary course of business, the Company is not a guarantor or otherwise is liable for any material liability or material obligation (including indebtedness) of any other person. Except as otherwise required under applicable state and federal law, the Company has not made or given any warranties with respect to any of the products distributed by the Company.
Guaranties and Warranties. The Foundation shall use its good faith efforts to obtain normal and customary warranties or guaranties from each Construction Consultant for the work to be performed by each Construction Consultant in connection with the Project, which are fully assignable to the Industrial Board and the Metropolitan Government upon request. The Industrial Board and the Metropolitan Government shall cooperate with the Foundation in enforcing any such warranties and guaranties so as to minimize the cost of maintaining the Project.
Guaranties and Warranties. Contractor warrants and guaranties that the Work shall be first class in every particular and free from defect in materials, construction and workmanship. Contractor further warrants and guaranties that all material, appliances and fixtures, which become part of the work, shall be new (unless otherwise agreed by Inspire in writing). Contractor further warrants and guaranties that it shall obtain from subcontractors and vendors, and cause to be extended to Inspire, the best possible warranties and guaranties of third party manufactured equipment, appliances, materials and fixtures. Contractor agrees to perform, or have performed, corrections to remove any defects and/or deficiencies identified by Inspire during said one-year period, without any added charge to Inspire. Guaranties and Warranties. The warranties, guaranties and other similar rights, if any, relating to the Fixtures and the Equipment (the "Warranties"), to the extent in effect on the Closing Date and assignable by the terms thereof and pursuant to applicable laws and regulations;

Tenant shall retain at the Premises or at another location in the City and County of San Francisco, all warranties, guaranties, and operating manuals and information relating to the improvements, equipment, and systems in the Premises, and shall make the same available to Landlord for its review upon Landlord’s request.

As provided in Section 2.7.7, Developer shall assist Tenant in connection with the enforcement of applicable guarantees and warranties under the Contract Documents without payment of additional Developer Compensation.
