It is understood that multiple guarantee/guarantor signatures will or may be secured in connection to this lease, and that failure to secure said additional guarantors will not eliminate or excuse any obligation of guarantor and lessee(s).

GUARA NTEE. IF APPLICABLE; FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which are hereby acknowledged, the undersigned (“Guarantor”, whether one or more than one) does hereby absolutely, irrevocably, personally and unconditionally guaranty to Buckeye Real Estate (“Landlord”) the full, complete, absolute and punctual performance by (“Tenants”) jointly and severally of all of Tenants’ obligations under this lease. In connection with this Guaranty, Guarantor covenants and agrees that no modification, waiver, addition or deletion of tenants or amendment of any or all of the terms or conditions of the Lease shall in any manner alter, eliminate, excuse or relieve any obligations of Guarantor under this Guaranty, and Guarantor hereby waives notice of Tenants’ default under the Lease, notice of any such modification of, waiver of or amendment to the Lease and notice of acceptance of this Guaranty, demand for payment, protest, notice of protest and notice of non-payment or non-performance, and agrees that the time for the payment of any amounts under the Lease or any extension or renewal thereof or for the performance of any other term or condition contained therein may be waived or extended from time to time without notice to or the consent of Guarantor. Guarantor further waives any and all defenses and rights of setoff whether arising out of or in connection with the Lease, this Guaranty or otherwise. Lessees and Guarantor shall be jointly and severally responsible for the rent and all terms and conditions including negligence, as contained in the apartment lease and under Ohio law. The guarantor acknowledges that he/she is not a tenant as defined by law and hereby waive any notice required by the Ohio Revised Code Section 5321 et. seq. or 1923 et. seq. The undersigned hereby certifies under the penalty of perjury that the information contained in this application and any other attached financial information provided are true and accurate and that is such information is later discovered to be false, Lessor may terminate the undersigned’s tenancy (if any) and evict the undersigned forthwith. Any informality in securing all or any Guarantor signatures shall not waive or affect the responsibility and enforceability of all parties to this agreement, or the lease agreement.

  • Shift Rotation Routine shift rotation is not an approach to staffing endorsed by the Employer. Except for emergency situations where it may be necessary to provide safe patient care, shift rotation will not be utilized without mutual consent. If such an occasion should ever occur, volunteers will be sought first. If no one volunteers, the Employer will rotate shifts on an inverse seniority basis until the staff vacancies are filled.

  • Sick Leave Verification The Employer will not require verification for absences of less than 3 consecutive work days. Such verification or proof may be given to the supervisor/manager or Human Resources according to departmental policy. The Employer will not make unreasonable requests for sick leave verification.

  • LEAVE OF ABSENCE - UNION BUSINESS 11.08.01 Employees who have been elected or appointed to carry out business authorized by the Union on a full-time basis shall be granted a Leave of Absence for this purpose. The Union will advise the Company of the name(s) of such employee(s), the term of such leave, and the specific purpose. The Union shall repay the Company for the Company's costs incurred in Employee Benefit Plans and the employee(s) shall continue to pay their contributions directly to the Company. The Company shall provide such employees with free and reduced-rate transportation in accordance with Company regulations. Such employees shall continue to accrue seniority and service while on leave of absence.

  • Extra Trips A. Field trips (extra trips) shall be provided by rotation on a list composed of regular drivers who volunteer in descending order of classification seniority (defined in Article 39).

  • Flextime (a) For the purpose of this Agreement, flextime means the hours worked by an employee, or group of employees, who are given authority by the Employer to:

  • Sick Leave Separation Cash Out ‌ At the time of retirement from state service or at death, an eligible employee or the employee’s estate will receive cash for their compensable sick leave balance on a one (1) hour for four (4) hours basis. For the purposes of this Section, retirement will not include “vested out of service” employees who leave funds on deposit with the retirement system.

  • Sick Leave Abuse ‌ When the Employer suspects sick leave abuse, the employee will be provided the opportunity to explain the circumstances surrounding their sick leave use prior to disciplining the employee, or making reference to sick leave use in the employee’s performance evaluation. The Employer may not adopt or enforce any policy that counts the use of paid sick leave time as an absence that may lead to or result in disciplinary action for an authorized purpose. The Employer may not discriminate or retaliate against an employee for the use of paid sick leave for an authorized purpose.

  • Catastrophic Sick Leave Bank [a] The District will establish and manage a catastrophic sick leave bank from which eligible educators may draw leave under the conditions and restrictions outlined below. Teachers who wish to participate in the catastrophic sick leave bank program shall be required to contribute one (1) day of their available sick leave to the bank. This contribution must be made each year during the insurance open enrollment period, as designated by the District, by completing and submitting the appropriate form to the Human Resources Department. If the bank has a substantial balance of days remaining at the end of the academic year, the Association and District may agree to suspend the contribution requirement for one year. Any educator who did not previously participate in the bank but who desires to participate during the non- contribution year will be required to donate one (1) day to initiate eligibility by submitting the appropriate form to the Human Resources Department during the insurance open enrollment period, as designated by the District. [b] Only educators who have contributed to the bank and who have depleted their sick leave and personal leave balances shall be eligible to receive consideration for sick leave from the bank. [c] All requests for sick leave from the bank must be in writing and must be addressed to the Human Resources Director. Requests may be submitted and approved any time after the required sick leave has been contributed. The requests must include the reasons for the request, written verification from the attending physician indicating the nature and severity of the illness or health problem along with the projected recovery date, and the number of sick leave days requested. [d] Only severe, extended illness and catastrophic medical problems of an employee or immediate family member will be considered for leave withdrawals from the bank. Illness or medical problems of a short-term nature shall not be considered. Life-threatening illness or severe accidents requiring extended recovery periods will be given first priority. [e] Withdrawals from the bank for illness of the participating employee shall not exceed one hundred (100) leave days per employee during any four (4) year period. [f] Withdrawals from the bank for illness of an immediate family member shall not exceed twenty (20) days during any consecutive four (4) year period. For requests under this policy, immediate family members shall include husband, wife, son, daughter, father, mother, brother, sister, grandmother, and grandfather. In addition, exceptions may be considered by the Superintendent for other relatives or those who have virtually held the position of an immediate member of the family. [g] In all sick leave bank withdrawal requests, whether for the participating employee or for an immediate family member, the District reserves the right to approve requests, deny requests, or to approve only a portion of the leave days requested.

  • Sick Leave Donation In accord with state law and Medical Center policy, RN’s may donate sick leave to any employee entitled to receive such donations.

  • Annual Paid Sick Leave Fifteen (15) days sick leave per year shall be earned by an employee at the rate of 1.25 days for every month that an employee is employed.
