Common use of Governmental Approval Clause in Contracts

Governmental Approval. If KFHPWA has not received any necessary government approval by the date when notice is required under this Agreement, KFHPWA will notify the Contract Holder of any changes once governmental approval has been received. KFHPWA may amend this Agreement by giving notice to the Contract Holder upon receipt of government approved rates, benefits, limitations, exclusions or other provisions, in which case such rates, benefits, limitations, exclusions or provisions will go into effect as required by the governmental agency. All amendments are deemed accepted by the Contract Holder unless the Contract Holder gives KFHPWA written notice of non-acceptance within 10 days after receipt of amendment, in which event this Agreement and all rights to services and other benefits terminate on the said date.
