Government Contract. Government Contract" shall mean any prime contract, subcontract, letter contract, purchase order or delivery order executed or submitted to or on behalf of any Governmental Body or any prime contractor or higher-tier subcontractor, or under which any Governmental Body or any such prime contractor or subcontractor otherwise has or may acquire any right or interest.
Government Contract. PROVISIONS If this PO is being placed in fulfillment of an NCR contract with any national or local government entity, all provisions required by such contract to be included herein are hereby incorporated by reference with the same force and effect as if they were included in full text.
Government Contract. “Government Contract” shall mean any Contract that (a) is between any Tetraphase Company, on the one hand, and a Governmental Body, on the other hand or (b) is entered into by any Tetraphase Company as a subcontractor (at any tier) in connection with a Contract between another Person and a Governmental Body. All orders or calls under a Government Contract shall be deemed part of the same Government Contract.

Government Contract. The work covered by this Agreement relates to a prime contract or subcontract with the United States Government and is within jurisdiction of a Department or Agency of the United States.
Government Contract. Neither Borrower nor any Subsidiary of Borrower is subject to the renegotiation of any government contract in any material amount.
Government Contract. If this purchase order is issued in connection with the performance of a contract for a commercial item for the United States Government, the terms and conditions set forth in the Supplemental Purchase Order Terms and Conditions – Acquisition of Commercial Items and Services are incorporated into this purchase order. The Supplement can be found at xxxx://xxx.xxxxxx.xxx/site/Downloads/Supplemental Purchase Order Terms and Conditions.docx. It is Seller’s responsibility to notify Buyer in writing if Seller will be furnishing products or services which are non-commercial items pursuant to an United States Government contract.
Government Contract. If any Product sold to Buyer under this Agreement is purchased for a United States Government contract or subcontract, then the Buyer shall include such provisions in such contract or subcontract and attach such notices to the Products and other materials provided to the United States Government as will protect Optoplex’s intellectual property rights and other proprietary rights to the maximum extent possible under applicable law.
Government Contract. Borrower is not subject to the renegotiation of any government contract in any material amount.
Government Contract. (c) Except as set forth in the Disclosure Schedule, the Company has never been debarred or suspended from contracting (as a prime contractor or subcontractor at any tier) for or bidding on any Government Contract or, at any time during the past ten (10) years, had a Government Contract canceled or terminated, in whole or in part, by reason of a default or alleged default on the part of the Company. The Company is not currently debarred or suspended from (nor has it received written notice that it is under investigation with respect to a possible debarment or suspension from) bidding on or entering into any Government Contract. Except as set forth in the Disclosure Schedule, with respect to any Government Contract in effect as of the date of this Agreement, the Company has not received written notice (i) that any such Government Contract may be or will be terminated for convenience or by reason of a default or alleged default by the Company, (ii) that funding for any such Government Contract or governmental program involving the Company will be eliminated or substantially reduced or suspended, (iii) requiring or resulting in loss of use or substantial impairment or interference of use by the Company of any facilities owned by a governmental authority, or (iv) that any relevant budget authority or contract authority has been exceeded with respect to any such Government Contract to which the Company is a party. The Company does not anticipate incurring any cost overrun with respect to any Government Contract to which it is a party that is reasonably likely to have a Material Adverse Effect.
