Generating Facilities. (1) This sec- tion covers all portions of a generating plant including plant buildings, the generator step-up transformer, and the transmission switchyard at a gener- ating plant. Warehouses and equipment service buildings not associated with generation plants are covered under paragraph (e) of this section. Genera- tion plant buildings must meet the re- quirements of paragraph (e)(1) of this section.

Generating Facilities. All of Seller's generators, together with all protective and other associated equipment and improvements, necessary to produce electrical power at the Project, excluding associated land, land rights, and interests in land.
Generating Facilities. The Member certifies that the following devices constitute the total unit(s) of generating equipment installed and addressed under this Agreement. The Member also warrants that the Facilities have been authorized for connection to the distribution system through the execution of an appropriate Interconnection Agreement. Generating Facilities. GENCO shall not sell or otherwise assign any interest in any of its generating units (as set forth on Appendix C) except for (i) liens securing bona fide debt or other encumbrances incurred in the ordinary course of business, (ii) capital leases or (iii) sales or assignments made with LIPA's prior written consent, which consent shall be deemed to have been given in respect of any and all easements granted pursuant to either Section 5.3(d) of the Generation Purchase Right Agreement dated as of the date hereof by and between GENCO and LIPA or Paragraph 5 of the Grant of Future Rights attached as Schedule F to the Merger Agreement.
Generating Facilities. Subject to the prior written consent of Buyer, which shall not be unreasonably withheld, Seller may add additional Generating Facilities to this Agreement through an amendment to the Agreement. PG&E reserves the right to require, on a nondiscriminatory basis, the Interconnection Customer to provide such security, in a form reasonably acceptable to PG&E as indicated in Article 11 of the SGIA, an amount up to the cost consequences of any current tax liability. Upon request and within sixty (60) Calendar Days’ notice, the Interconnection Customer shall provide PG&E such ITCC security or ITCC payment in the event that Safe Harbor Provisions have not been met, in the form requested by PG&E.
