General Release of Liability. A “General Release of Liability” means the legal document in which the Executive Officer, in exchange for benefits under this Agreement, releases the Sterling Entities, their affiliates, their directors, officers, employees and agents, their employee benefit plans and the fiduciaries and agents of said plans from liability and damages in any way related to the Executive Officer’s employment with or separation from the Sterling Entities.

General Release of Liability. (A) You hereby unconditionally release Marca Via from any and all liability for any losses and damages (whether direct or indirect, known or unknown, foreseen or unforeseen, and including attorney fees) arising out of or in any way related to any of the following: (a) your violation of or failure to perform any obligation under this User Agreement; (b) our rejection of or refusal to accept any order (in whole or in part); (c) our cancelation or discontinuance (in whole or in part) of any Promotion; (d) any incorrect pricing; (e) any inaccurate or incomplete product information; (f) our termination or suspension of your use; (g) your cancelation of an order; and (h) your improper use of any product purchased through our Services.
General Release of Liability. By executing this agreement, You acknowledge and understand that no activity, piece of equipment, property or location is 100% safe and without any risk of injury, including school buildings, vehicles, playgrounds, sidewalks, and parking lots. Likewise, there is no amount of supervision that will completely protect any person, including your Student, from his or her own conduct or the wrongful conduct of third parties. While Page Academy always endeavors to create a safe environment for You and your Student, not all risk of harm can be anticipated or avoided. AS SUCH, WHILE YOU OR YOUR STUDENT IS PRESENT ON ANY PROPERTY OWNED OR CONTROLLED BY PAGE ACADEMY, USING EQUIPMENT OWNED OR CONTROLLED BY PAGE ACADEMY, OR PARTICIPATING IN ANY ACTIVITY OFFERED BY OR THROUGH PAGE ACADEMY, YOU, ON BEHALF OF YOURSELF, YOUR STUDENT, AND YOUR HEIRS, HEREBY AGREE TO WAIVE ANY AND ALL PAST, CURRENT, AND FUTURE CLAIMS AGAINST PAGE ACADEMY, ITS EMPLOYEES, OFFICERS, DIRECTORS, OR AGENTS FOR ANY INJURY, ACCIDENT, ILLNESS OR DEATH WHICH MAY RESULT DIRECTLY OR INDIRECTLY FROM SUCH PRESENCE, USE OR PARTICIPATION, TO THE FULLEST EXTENT PERMITTED BY LAW. General Release of Liability. You, on behalf of yourself and your child, hereby fully and forever release, defend, and hold harmless BCS Sitters and BCS Sitters’s officers, directors, owners, agents, employees, volunteers, representatives, parents, subsidiaries, affiliates, successors, trustees, assigns, and transferees from and against any and all claims, demands, actions, liabilities, losses, damages, and judgements of any type and nature whatsoever that you or your child have or may have (now or in the future, whether known or unknown, and whether foreseeable or unforeseeable) against all or any such releasees arising from or in relation to any or all of the following (including, without limitation and by way of example only, CLAIMS FOR PERSONAL INJURY, EMOTIONAL INJURY, PROPERTY DAMAGE, DEATH, DISABILITY, BODILY HARM, MENTAL ANGUISH, INJURY TO IMAGE OR REPUTATION, LOSS OF EARNING CAPACITY, LOST WAGES, INFRINGEMENT, INVASION OF PRIVACY, MISAPPROPRIATION OF THE RIGHT OR PUBLICITY, DEFAMATION, DISPARAGEMENT, EMOTIONAL DISTRESS, DISCRIMINATION, HARASSMENT, NEGLIGENCE, RECKLESSNESS, ASSAULT, BATTERY, TORTIOUS INTERFERENCE, TRESPASS, CRIMINAL LIABILITY, INDECENCY, FRAUD, MISREPRESENTATION, CONTRIBUTION, INDEMNIFICATION, REIMBURSEMENT, SPECIAL DAMAGES, EXEMPLARY DAMAGES, ATTORNEYS’ FEES, COSTS, and any other legal theory arising from or in relation to any or all of the following): (a) your or your child’s attendance at or participation in all or any parts of the Camp (including, without limitation, any and all events and activities conducted at, around, or as part of the Camp); (b) the acts, errors, omissions, or negligence of BCS Sitters or BCS Sitters’ officers, directors, owners, agents, employees, volunteers, representatives, parents, subsidiaries, affiliates, successors, trustees, assigns, transferees, guests, or invitees; (c) the acts, errors, omissions, or negligence of any other campers (or the respective parents, legal guardians, family, or friends of those other campers); and/or (d) your or your child’s disaffirmation or breach of any term, condition, representation, warranty, or covenant under this Agreement.

General Release of Liability. The Sponsor understands that participation in the Diamond Ranch Academy Program relies on group participation by adolescents who have a history of aberrant, uncontrolled and sometimes dangerous behavior. Participation may also involve potentially dangerous and physically strenuous activities including, but not limited to, such activities as travel, exercising, swimming, fishing, boating, ropes courses, rafting, hiking, camping and other similar activities. The Sponsor hereby releases Diamond Ranch Academy, its officers, directors, employees or agents from any liability for injury, illness, death, loss, costs, or other damage to the Participant during participation or enrollment in the Diamond Ranch Academy Program. This release further extends to any injury, illness, death, loss, costs, or other damage to the Participant that may be attributable to, or in any way arise from, the Participant’s own conduct, behavior or history of pre-existing conditions or dispositions.

  • Scope of Liability Neither the Servicer or any subservicer appointed by it, nor any of their respective partners, directors, officers, employees or agents, or its delegees pursuant to Section 11.2.1 hereof, shall be under any liability to the Master Servicer, the Trustee or, if applicable, the Trust Administrator for any action taken or for refraining from the taking of any action in good faith pursuant to this Agreement, or for errors in judgment; provided, however, that this provision shall not protect the Servicer, any subservicer or any of their respective partners, directors, officers, employees or agents, or its delegees pursuant to Section 11.2.1 hereof, against any liability which would otherwise be imposed by reason of willful misfeasance, bad faith or gross negligence in the performance of his or its duties or by reason of reckless disregard of his or its obligations and duties hereunder.   • Mutual Release of Claims a. Employee further agrees that Employee will not file or permit to be filed on Employee’s behalf any such claim. Notwithstanding the preceding sentence or any other provision of this Agreement, this release is not intended to interfere with Employee’s right to file a charge with the Equal Employment Opportunity Commission (the “EEOC”), or other comparable agency, in connection with any claim Employee believes Employee may have against Matador or its affiliates. However, by executing this Agreement, Employee hereby waives the right to recover in any proceeding Employee may bring before the EEOC or any state human rights commission or in any proceeding brought by the EEOC or any state human rights commission on Employee’s behalf. This release shall not apply to any of Matador’s obligations under this Agreement or post-termination obligations under the Employment Agreement, any vested retirement plan benefits, any vested equity grants or COBRA continuation coverage benefits. I acknowledge that I have signed this Waiver and Release of Claims voluntarily, knowingly, of my own free will and without reservation or duress, and that no promises or representations have been made to me by any person to induce me to do so other than the promise of payment set forth in the first paragraph above and the Employer’s acknowledgment of my rights reserved under the second paragraph above. I understand that this release will be deemed to be an application for benefits under the Agreement and that my entitlement thereto shall be governed by the terms and conditions of the Agreement and any applicable plan. I expressly hereby consent to such terms and conditions. I acknowledge that (i) I am waiving any rights or claims I might have under the Age Discrimination in Employment Act, as amended by the Older Workers Benefit Protection Act (“ADEA”); (ii) I have received consideration beyond that to which I was previously entitled; (iii) I have been given forty-five (45) days to review and consider this Waiver and Release of Claims (unless I have signed a written waiver of such review and consideration period); (iv) I have had the opportunity to consult with an attorney or other advisor of my choice and have been advised by the Company to do so if I choose; and (vi) I have been separately furnished a written schedule of all persons, listed by job title and age, within the affected decisional unit who were selected and not selected for the benefits extended by this Agreement, as may be required by the ADEA. I may revoke this Waiver and Release of Claims seven days or less after its execution by providing written notice to the Employer. I acknowledge that it is my intention and the intention of the Employer in executing this Waiver and Release of Claims that the same shall be effective as a bar to each and every claim, demand and cause of action hereinabove specified. In furtherance of this intention, I hereby expressly waive any and all rights and benefits conferred upon me by the provisions of SECTION 1542 OF THE CALIFORNIA CIVIL CODE, to the extent applicable to me, and expressly I consent that this Waiver and Release of Claims shall be given full force and effect according to each and all of its express terms and provisions, including as well those related to unknown and unsuspected claims, demands and causes of action, if any, as well as those relating to any other claims, demands and causes of action hereinabove specified.
