FWS. The mission of the FWS is to work with others to conserve, protect, manage, and enhance fish, wildlife, plants, and their habitats for the continuing benefit of the American people. The FWS Division of Migratory Bird Management serves as a focal point in the United States for policy development and strategic planning, program implementation, and evaluation of actions designed to conserve migratory birds and their habitats. The FWS is legally mandated to implement the conservation provisions of the MBTA, which includes responsibilities for managing migratory bird populations, domestic and international coordination, and the development and enforcement of regulations. The Migratory Bird Conservation Act and the Fish and Wildlife Coordination Act mandate migratory bird habitat conservation including habitat protection through acquisition, enhancement, and/or management, and avoidance and minimization of impacts. FWS programs that involve bird conservation activities include:

FWS a) Issue an enhancement of survival permit to the CEHMM under section 10(a)(1)(A) of the ESA in accordance with 50 CFR 17.32 (d) should the species be listed at some time in the future, to commence upon the listing of the LPC and/or SDL and continuing through the remainder of the term of this Agreement, that would provide CEHMM and Participating Landowners with authorization for incidental take of LPCs and/or SDLs and provide regulatory assurances. The permit, if issued, would authorize take of LPCs and/or SDLs resulting from otherwise lawful activities on enrolled lands that is consistent to the incidental take anticipated under the CCAA.

With respect to migratory birds, the Service’s goals are to ensure long-term ecological sustainability of all migratory bird populations, increase socioeconomic benefits, improve hunting and birdwatching and other outdoor bird-related experiences, and increase awareness of the value of migratory birds and their habitats for their intrinsic, ecological, recreational and economic significance. FAA – The FAA has authority to enter this MOU under 49 USC § 40103, and 44718. 49 USC § 40103, Sovereignty and use of airspace, vests the FAA with broad authority to regulate the safe and efficient use of navigable airspace. 49 USC § 44718, Structures interfering with airspace, provides that that if the construction or alteration of a structure may result in an obstruction of the navigable airspace or interference with air navigation facilities and equipment, the FAA shall “conduct an aeronautical study to decide the extent of any adverse impact on the safe and efficient use of airspace, facilities, or equipment.”
FWS. The purpose of an FWS is to allow the employee to determine their work schedule within the limits established by the Employer. An FWS includes designated hours (core hours) and days when an employee must be present for work. An FWS also includes designated hours during which an employee may elect to work in order to complete the employee’s basic (non-overtime) work requirement (5 USC 6122).
FWS. A school must time its FWS drawdowns to coincide with its payroll dates. A school must calculate the amount of federal funds needed to meet FWS payroll for a given pay period and draw down only the appropriate federal share of wages to be paid. Student wages must be paid within three business days of the date federal funds are received.
