Fumes. An employee required to work in a place where fumes of sulphur or other acid or other offensive fumes are present will be paid such rates as are agreed, or determined in accordance with the dispute resolution procedure. Any special rate so fixed will apply from the date the enterprise is advised of the claim and thereafter will be paid as and when the fume condition occurs.

Fumes may be produced on a project site for a variety of reasons such as use of motorized equipment, off gassing of sealants, adhesives and finish products, cutting/torching processes, exposure of sanitary systems, process ignition gases such as propane and acetylene, proximity of project temporary washrooms, radon, etc.
Fumes. During the performance of work under this contract, the Contractor may elect to engage in activities, or to use methods and materials, that result in fumes (including smoke) being generated and dispersed in occupied areas. In addition to complying with all codes and ordinances having jurisdiction, the Contractor will perform his work in a manner that will minimize or completely eliminate the probability of such an occurrence. However, if fumes of any nature are generated or released by the Contractor to occupied areas of the building, such fumes will be contained and exhausted from the areas in accordance with previously cited codes and ordinances. If any Contractor generated or Contractor released fumes spread to occupied spaces, the Contractor will: Stop work immediately that is causing fumes/smoke generation or release. Report condition immediately to the Owner’s Project Manager Determine the nature and extent of the fume/smoke release. Purge all areas of these fumes/smoke; clean areas if fumes/smoke deposited dirt or particulate matter. Change work methods to eliminate any fumes/smoke in the future. Continue working after steps 1 thru 5 have been accomplished Contractor will not locate odor-producing materials and/or equipment in the vicinity of building vents and shall maintain a 35’ buffer from all buildings.

However, if fumes of any nature are generated or released by the Contractor to occupied portions of a building, such fumes shall be contained and exhausted from the spaces in accordance with previously cited codes, ordinances, and Laws.
