FTC Order. NMS will, at all times, maintain compliance with the FTC Order.
FTC Order. The parties acknowledge the existence the FTC Order. Nothing in this Agreement shall be construed as limiting or restricting GeoCities from complying fully with the FTC Order. Be Free shall cooperate fully with GeoCities to ensure compliance with the FTC Order in connection with the collection and use of GeoCities Data or otherwise.
FTC Order. 1. Section 13.1 is hereby amended by replacing the first sentence with the following sentence: "The parties acknowledge the existence of the FTC Order and Be Free acknowledges that it has received a copy of the FTC Order and is aware of its provisions.
FTC Order. The thirty (30) day notification period pursuant to the FTC Order shall have expired or have been waived;
FTC Order. The Assets described herein are consistent with the terms “Philadelphia Area Terminals”, “San Francisco Bay Terminals” and “West Pipeline System” in the FTC Order, it being understood that nothing in this Section 2.6 is intended to enlarge or contract the Assets to be conveyed pursuant to this Agreement.
FTC Order. NMS is in compliance with all requirements of the FTC Order.
FTC Order. (a) On the date that is 120 days after the FTC Order Date, the Sellers shall pay the Company an amount, if any, equal to the sum of (x) the First Affiliate True-Up plus (y) the Second Affiliate True-Up; provided, that if the gross revenues of the Company and its Subsidiaries for the Pre-Order Period is equal to or greater than 97% of such revenues for the Post-Determination Period, then no payment shall be required under this Section 7.05.
FTC Order. Contemporaneously with the delivery to the Federal Trade Commission of any report or other document required pursuant to, or requested in connection with, the FTC Order, a copy of such report or other document.

FTC Order. Buyer agrees to be bound by the provisions of that certain Decision and Order of the Federal Trade Commission, FTC Docket No. C-3619 (October 3, 1995) ("FTC Order") for the remainder of the term of the FTC Order. For purposes of Paragraphs VI and VII of the FTC Order, the "relevant area" shall mean only the Ville Platte-Mamou-Opelousas area, encompassing the Louisiana parishes of Evanxxxxxx xxx St. Landxxx, xx defined in Paragraph I, Section J(5) of the FTC Order.
