Franchise Grant. The Franchise Authority hereby grants to the Franchisee under the Code of Virginia and the Cable Act a non-exclusive Franchise authorizing the Franchisee to construct and operate a Cable System in the Public Ways within the Franchise Area, and for that purpose to use, erect, install, construct, repair, alter, add to, inspect, replace, reconstruct, maintain, or retain in any Public Way such poles, wires, cables, conductors, ducts, underground conduits, vaults, manholes, pedestals, amplifiers, appliances, attachments, and, including but not limited to, above ground enclosures, markers, and concrete pads, or other related property, equipment, or fixtures as may be necessary, useful, or appurtenant to the Cable System, and to provide such services over the Cable System as may be lawfully allowed.

Cooling off and early termination The Franchisee acknowledges having received a copy of the franchising code, the disclosure document and this Agreement more than 14 days before signing this Agreement. The Franchisee may terminate this Agreement by written notice served on the Franchisor within seven days from signing this Agreement but will remain bound by the provisions intended to survive termination. In the event of the Franchisee terminating this Agreement within such seven day period then the Franchisor shall refund all amounts paid by the Franchisee to Franchisor less a reasonable contribution towards the costs incurred by the Franchisor in recruiting and training the Franchisee and preparing the associated documentation. Franchisee’s initial obligations The Franchisee shall immediately, following the expiration of the seven day cooling off period, following the execution and delivery hereof by the Franchisee and the Principals: Do all such things as are necessary to secure the premises if any for the conduct of the business; Pay the Initial Fee to the Franchisor or as the Franchisor may direct; Pay the Bond to the Franchisor or as the Franchisor may direct; Pay the Training Fee to the Franchisor or as the Franchisor may direct and arrange with the Franchisor a mutually convenient time to commence the Training Program; Complete the Training Program in a timely manner; Obtain all consents, licences and approvals as may be necessary for the conduct of the franchise business; and If applicable appoint the nominated representative to liaise with the Franchisor in accordance with the provisions hereof.
Franchise Grant. The Town hereby grants to the Service Provider, in accordance with the Town’s ordinances and regulations governing the collection, hauling and disposal of Municipal Solid Waste and Construction and Demolition Waste, the nonexclusive franchise, license and privilege to collect, haul and dispose of Municipal Solid Waste and Construction and Demolition Waste over, upon, along and across the Town’s present and future streets, alleys, bridges, rights-of-ways and public properties.

Franchise Grant. A. Non-Exclusive Grant and Acceptance. COUNTY grants to FRANCHISEE and FRANCHISEE accepts the non-exclusive right and privilege to provide franchise services with respect to solid waste discarded in bins and roll-off boxes and within the unincorporated areas of the COUNTY. In COUNTY’S sole discretion, COUNTY may also grant to other persons the same rights and privileges that it grants FRANCHISEE under this Agreement. COUNTY is not liable to FRANCHISEE for acts of anyone who provides solid waste management services without a permit or franchise required by law, and FRANCHISEE releases COUNTY from any liability in connection with any of those acts.
