FORBEARANCE BY LENDER NOT A WAIVER. Any forbearance by Lender in exercising any right or remedy hereunder, or otherwise afforded by applicable law, shall not be a waiver of or preclude the exercise of any right or remedy. The acceptance by Lender of payment of any sum secured by this Instrument after the due date of such payment shall not be a waiver of Lender's right to either require prompt payment when due of all other sums so secured or to declare a default for failure to make prompt payment. Lender's receipt of any awards, proceeds, or damages under the Mortgage shall not operate to cure or waive Guarantor's default in payment of sums due under this Guaranty. With respect to all Loan Documents, only waivers specifically and expressly made in writing by Lender shall be effective against Lender. References in this Guaranty or any other Loan Document, if any, to the "continuance of an Event of Default" or words of similar import shall not be deemed or construed to mean that Lender is agreeing to excuse or to extend the time by which Borrower or Guarantor, as the case may be, may cure such Event of Default or to delay or waive Lender's right to exercise any rights or remedies to which Lender may be entitled by reason of such Event of Default.
