For the purposes of this Article. (a) The legal costs will be deemed to have been incurred by the member notwithstanding that s/he may have received financial assistance from the Association in that regard or that the Association paid or incurred the cost directly; (b) "Member" shall include a former member and/or his/her estate where the charge and/or action arose out of an incident(s) which occurred while the member was actively employed by the Board; and (c) Where a member is a party to proceedings outside Ontario for which s/he is entitled to legal indemnification, legal costs shall be deemed to include all reasonable out of pocket expenses associated with the proceedings, including travel, accommodation and meal expenses consistent with the Board's policies and practices for other types of work-related travel.
