Flood Hazard Area. Mortgagor represents that neither the Premises nor any part thereof is located in an area identified by the Secretary of the United States Department of Housing and Urban Development or by any applicable federal agency as having special flood hazards or, if it is, Mortgagor has obtained the insurance required by Section 1.09.

Flood Hazard Area. The Controlled Properties are not located in an area identified by the Secretary of Housing and Doc #1273038 Urban Development as an area having special flood hazards pursuant to the terms of the National Flood Insurance Act of 1968, or the Flood Disaster Protection Act of 1973, as amended. If after the date hereof the area in which the Controlled Properties are located is identified or designated as such an area, Borrowers will obtain and maintain insurance against damage or loss by flood on such basis and in such amounts as shall be required from time to time by Lender.
