Common use of Flood Determinations Clause in Contracts

Flood Determinations. The Administrative Agent shall have received a completed “Life-of-Loan” Federal Emergency Management Agency Standard Flood Hazard Determination with respect to each Mortgaged Fee Property, and to the extent any Mortgaged Fee Property is located in a special flood hazard area, (i) a notice about special flood hazard area status and flood disaster assistance duly executed by the Borrower and (ii) evidence of flood insurance as required by Section 7.5 of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative Agent.

Flood Determinations. The Administrative Agent shall have received a completed “Life-of-Loan” Federal Emergency Management Agency Standard Flood Hazard Determination standard flood hazard determination with respect to each Mortgaged Fee PropertyReal Property which has a “Building” on it (as such term is defined in the Flood Laws), and to the extent any Mortgaged Fee Property which such “Building” is located in encumbered by a special flood hazard area, Mortgage as set forth on Schedule 7.1.1(n) (i) together with a notice about special flood hazard area status and flood disaster assistance duly executed by the Borrower and (ii) evidence of flood insurance as required by Section 7.5 of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative AgentBorrower).

Flood Determinations. The Administrative Agent shall have received a completed “Life-of-Loan” Federal Emergency Management Agency Standard Flood Hazard Determination with respect to each Mortgaged Fee Property, and to the extent any Mortgaged Fee Property is located in a special flood hazard area, (i) a notice about special flood hazard area status and flood disaster assistance duly executed by the U.S. Borrower and (ii) evidence of flood insurance as required by Section 7.5 of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative Agent.

Flood Determinations. The Administrative Agent shall have received with respect to each Mortgaged Property (i) a completed “Lifelife-of-Loanloan” Federal Emergency Management Agency Standard Flood Hazard Determination with respect to each Mortgaged Fee Property, and to the extent any Mortgaged Fee Property is located in a special standard flood hazard area, determination (i) together with a notice about special flood hazard area Special Flood Hazard Area status and flood disaster assistance duly executed by the Borrower applicable Loan Party relating thereto) and (ii) evidence of flood insurance as required by satisfying the requirements of Section 7.5 5.4 of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative Agent.

Flood Determinations. The Administrative Agent shall have received a completed “Life-of-Life of Loan” Federal Emergency Management Agency Standard Flood Hazard Determination with respect to each Mortgaged Fee Property, and to the extent any Mortgaged Fee Property is located in a special flood hazard area, (i) together with a notice about special flood hazard area status and flood disaster assistance duly executed by the Borrower and (iithe applicable Loan Party relating thereto) and, if any such Mortgaged Property is located in a special flood hazard area, evidence of flood insurance as required by pursuant to Section 7.5 5.07(c) of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative AgentAgreement.

The Administrative Agent shall have received obtained with respect to each Mortgaged Property a completed “Life-of-Loan” Federal Emergency Management Agency Standard Flood Hazard Determination (together with respect to each Mortgaged Fee Property, and to the extent any Mortgaged Fee Property is located in a special flood hazard area, (i) a notice about special flood hazard area status and flood disaster assistance duly executed by the Borrower and (ii) evidence of flood insurance as required by Section 7.5 of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative Agentapplicable Loan Party relating thereto).

The Administrative Agent shall have received a completed “Life-of-Loan” Federal Emergency Management Agency Standard Flood Hazard Determination with respect to each of the Mortgaged Fee Property, and to the extent any Mortgaged Fee Property is located in a special flood hazard area, Properties (i) together with a notice about special flood hazard area status and flood disaster assistance duly executed by the Borrower and each Loan Party (iiother than ABG) evidence of relating thereto in the event any such Mortgaged Properties are located within a special flood insurance as required by Section 7.5 of the Credit Agreement and otherwise in form and substance reasonably satisfactory to the Administrative Agenthazard area).
