Firmware. The Contractor shall deliver firmware required for production acceptance testing in accordance with CDRL A009 Contractor’s Supplier Configuration Management Plan. Firmware and software used for operation and maintenance reporting. Notwithstanding the foregoing, Enova will make reasonable efforts to resolve firmware or software problems.
Firmware updates Xxxxxxxx, may make available future Smart Hub Firmware Updates; notification of updates will be distributed to emails registered to users of the DMP. Xxxxxxxx strongly recommends that Smart Hubs should be updated and always running the latest version of Firmware. These updates may include bug fixes, feature enhancements or improvements, or entirely new versions of the Software DMP Update From time to time, Xxxxxxxx may update the Software used by the DMP. Notification of updates will be distributed to emails registered to users of the DMP.
Firmware. No other person shall have any rights to enforce any of these terms. If you download and install the Firmware or connect or otherwise use the Device, you are indicating that you have read and understood, and agree to be bound by, the terms of this Agreement. If you do not agree to the terms of this Agreement, you should not download the Firmware, you are not granted any rights whatsoever in the Firmware and you should not use the Device.
Firmware. PMI reserves the right to update the Firmware from time to time in its sole discretion, including adding, changing or removing functionalities and features. PMI is under no obligation to provide any updates to the Firmware.
Firmware. The Firmware is licensed, not sold. Customer owns the Hardware on which the Firmware is recorded, but Xxxxxxx retains ownership of the copy of the Firmware itself, including all intellectual property rights therein. The Firmware is protected by United States copyright law and international treaties. Samsara reserves all rights in the Firmware not expressly granted to Customer in these Terms. Customer acknowledges and agrees that portions of the Firmware, including but not limited to the source code and the specific design and structure of individual modules or programs, constitute or contain trade secrets of Samsara and its licensors. Wifi Data Usage. Where applicable, any Vehicle Gateway license identified on an Order Form includes up to 500MB per month of WiFi data with the Enterprise License (LIC-VG-ENT) or up to 200MB per month of WiFi data with the Express License (LIC-VG-EXPRESS). Connectivity between the Vehicle Gateway and Samsara Services does not count towards the monthly WiFi data provision. Samsara reserves the right to limit access to personal entertainment streaming services. Data usage above the monthly threshold may result in the reduction of connection speeds, the restriction of connectivity, the interruption of connectivity, or some combination thereof. Restriction or interruption of connectivity will not impact the function of HOS Logs. Customer may track data usage from the Gateways page within the Settings section of the Samsara dashboard.
Firmware for a model shall be made available for a minimum period of five years after the Placing on the Market of the last unit of the relevant Product model, free of charge or at a fair, transparent and non-discriminatory cost. Provision of Signatory policy/guidance document demonstrating standard time period for provision of firmware.
Firmware. Plexus is responsible for the validation of any Plexus software used in production in, or as part of the Quality System. The responsibilities described in this section also apply to any revisions of any software.
Firmware iii. Patch Management
Firmware. Customer acknowledges that software is resident in the MCTs and in certain other accessory Equipment which may be provided to Customer hereunder ("Firmware"), and that access to and use of which shall be governed by the general provisions relating to Software set forth in Sections 2.1, 2.3, and 2.4 below.
