Common use of Financial Plans Clause in Contracts

Financial Plans. As soon as practicable and in any event no later than (a) March 31, 1999, for the Fiscal Year ending December 31, 1999, and (b) 30 days after the beginning of each Fiscal Year thereafter, a consolidated plan and financial forecast for such Fiscal Year (the "Financial Plan" for such Fiscal Year), including, without limitation, (i) forecasted consolidated balance sheets and forecasted consolidated statements of income and cash flows of Company and its Subsidiaries for such Fiscal Year, together with pro forma compliance calculations for such Fiscal Year and an explanation of the assumptions on which such forecasts are based, and (ii) forecasted consolidated statements of income and cash flows of Company and its Subsidiaries for each quarter of such Fiscal Year, together with an explanation of the assumptions on which such forecasts are based;
