Final Court Approval of the Settlement. At least fourteen (14) calendar days before the final Fairness Hearing set by the Court, Plaintiffs will file a motion for final approval of the Settlement and proposed Final Order and Judgment:

Final Court Approval of the Settlement. A. No later than seven (7) days before the scheduled Fairness Hearing, the Named Plaintiffs shall move for the Court’s final approval of this Settlement, and Plaintiffs and Defendants agree to use their best efforts to obtain such approval, and Defendants will not oppose Plaintiffs’ requests for, and any approvals, denials, modifications or appeals concerning Plaintiffs’ Plan of Allocation.

The remedies referred to in subparagraph 1(b) shall be deemed to be exhausted if a final determination in the matter has not been issued by the competent authority within one year of the institution of an administrative proceeding, and the failure to issue a determination is not attributable to delay caused by the business person.
