Filling Permanent Vacancies. Permanent vacancies shall be filled by the most senior qualified applicant who, in the opinion of the Director of Transportation, is qualified and capable of adequately performing the assignment. An employee shall be deemed to be “qualified and capable of adequately performing the assignment” for an assignment in the same classification as the employee’s current assignment. [Example: A driver will be deemed to be qualified and capable of adequately performing the assignment for all driving positions.] In addition, the provisions of Article 15.05 shall apply when filling any permanent vacancies in noon runs.
Filling Permanent Vacancies. In filling a permanent vacancy in a full-time or part-time certificated position covered by this Agreement, the Employer shall consider any respective applicant's ability, qualifications, experience, length of service with the Employer, the best interests of all students and the School District, and any other factors the Employer considers pertinent.

Posting and Qualifications - Permanent vacancies in existing or newly created job classifications which the Company determines are necessary to fill will be filled by posting for bid for 3 working days within the department where the vacancy exists. The employees in the department where the vacancy exists shall have the right to bid on the vacancy, and such vacancy shall be filled on the basis of plant seniority provided that the employee is capable of learning and satisfactorily performing the work.
Filling Permanent Vacancies. (a) Notwithstanding Section 9.10 a permanent vacancy is a vacancy where the duration of the work is intended to exceed twenty-one (21) working days.

When a vacancy exists, the vacancy will first be offered to Fluor-BWXT Portsmouth LLC USW- represented employees laid off from the job classification in which the vacancy exists and who are on the Classification Recall List for the job classification in which the vacancy exists. The term “first consideration” does not mean that the employees requesting transfer to the vacant position have first priority to the job, nor does it require the appointing authority to appoint an employee from such list to the vacancy, but only assures that such employees shall in fact be given consideration for the position prior to reviewing other candidates.
Filling Permanent Vacancies. 1. All permanent vacancies and new jobs with their respective job descriptions and wage rates shall be posted on the bulletin board for a period of seven {7} days. The City reserves the right to require testing and the setting of qualifications for any vacancy. Forms for making application will be made available to the employees. The City may determine aptitude and qualifications in generally accepted ways, i.e., written, oral, and performance tests; interviews; etc. The City shall fill permanent vacancies that have been posted based on the qualifications of bargaining unit members. When the qualifications of two or more applicants are equal, the vacancy shall be filled by the most senior employee. If no bargaining unit members are qualified, the vacancy may be filled from outside the bargaining unit.

Filling Permanent Vacancies. If the Company determines it is necessary to fill a permanent vacancy, it shall be filled in the following manner: The vacancy shall be posted in the group where the vacancy exists for a period of five (5) calendar days. The Company shall then select the most qualified senior employee who has bid on the vacant position. However, when a bid job becomes available that an employee would have otherwise been awarded based on his seniority had he been qualified, the Company will award him the bid and provide the training necessary so long as the employee has not turned down the training opportunity when last offered on their bid shift. Should this employee fail to qualify on the awarded bid job, he shall be able to exercise his seniority on any available bid job for which he is qualified. The Company will determine the training needs. If no eligible (as defined above) employee within the group has signed the bid, the vacancy may be posted on a Plant Wide basis following the steps outlined above. Department bids will become effective two (2) weeks after they are posted except, due consideration will be given to eligible (as defined above) employees who are absent from the Plant while the bid is posted because of vacation, sickness or other excused absence. After the above guidelines are met, then the Company may fill the vacant position from the outside.
