Filling of Vacancies or New Positions. Vacancies or new positions shall be filled on the basis of seniority provided that the applicant possesses the necessary qualifications required to fill the position and the ability to perform the required work. If no applicant is appointed from within the Bargaining Unit for a vacancy or position, the Employer(s) shall give next consideration to an applicant(s) in the geographic Health Region. Should an Employer fail to fill a position in the geographic Health Region the posting shall be posted in the other SGEU Health Region(s) prior to an open competition. An Employee shall transfer her/his seniority, unused sick leave credits earned in the previous twenty-four (24) month period and the most recent vacation accrual rate.

Filling of Vacancies or New Positions. When a vacancy occurs in the Classified Service for a bargaining unit position or a new classified position is created in the bargaining unit, it shall be advertised for at least ten (IO) working days prior to the established closing date. Where practicable, notices of vacancies shall be posted either electronically or on bulletin boards and, upon request, shall be provided in print or braille where the posting location has the capacity to do so. Notwithstanding Article above, the Employer may hire qualified candidates who previously applied for a similar vacancy or new position in the same classification at the worksite from which the vacancy originates provided that a competition was held during the previous twelve (12) months. The Employer may utilize this provision to fill a vacancy or vacancies at the from which the vacancy or vacancies originate, regardless of the worksite of the applicant. The Employer in these circumstances, is not required to post or advertise the vacancy or new position. The Employer will notify the Association prior to Article being invoked. Where an employee has filled a position on a temporary, full-time basis for at least eighteen (18) months, the Employer may assign him or her to the position on a permanent basis and Article (Posting and Filling of Vacancies or New Positions) shall not apply.

Filling of Vacancies or New Positions. 15.01 First Consideration The Employer agrees that when a vacancy occurs or a new position is created within the BCNU Bargaining Unit, the Employer shall give employees in the Bargaining Unit within the home, provided there are no employees currently on lay-off, first notice and first consideration in filling the vacancy or new position. Each employee who applies for the vacancy or new position shall be given equal opportunity to demonstrate fitness for the position by formal interview and/or assessment. Where an employee within the BCNU Bargaining Unit is not appointed to fill the vacancy or a new position, the employee shall be given an explanation within seven (7) calendar days of the appointment of the successful candidate as to why the employee's application was not accepted.

THE EMPLOYER SHALL POST ANY NEW POSITIONS IN ACCORDANCE WITH ARTICLE NOTWITHSTANDING ARTICLE UPON COMPLETION OF TWELVE (12) CONSECUTIVE MONTHS IN THE NEW DEVELOPMENTAL POSITION THE EMPLOYER MAY CHOOSE TO CONVERT THE NEW DEVELOPMENTAL POSITION TO A FULL- TIME, REGULAR POSITION. THE INCUMBENT BARGAINING UNIT MEMBER MAY BE APPOINTED TO THE NEWLY ESTABLISHED FULL-TIME, REGULAR POSITION AT THE SPECIFIED CLASS AND RATE OF PAY. WHERE THE INCUMBENT BARGAINING UNIT MEMBER IS NOT APPOINTED TO THE NEWLY ESTABLISHED FULL-TIME, REGULAR POSITION, THAT MEMBER SHALL REVERT TO THEIR FORMER POSITION WITH NO LOSS OF SENIORITY CREDITS OR BENEFITS. The notice of vacancy shall state, where applicable, the nature and title of position, salary, qualifications required, and the hours of work schedule as set out in Article (Hours of Work). In filling a vacancy, the Employer shall give primary consideration to qualifications and ability to perform the required duties. Where qualifications and ability are relatively equal, length of continuous service shall be a consideration. WHEN POSTING VACANCIES, IF MORE THAN THE POSTED NUMBER OF QUALIFIED CANDIDATES ARE FOUND WITHIN THREE (3) MONTHS OF THE DATE OF POSTING, THE ADDITIONAL QUALIFIED CANDIDATES MAY BE APPOINTED TO THE POSITION, AT THE EMPLOYER'S DISCRETION, AND RE-POSTING SHALL NOT APPLY. An applicant who is invited by the Employer to attend an interview shall be granted time off with no loss of pay and with no loss of credits to attend the interview.

  • VACANCIES AND NEW POSITIONS 17.01 The Gallery shall post notice of permanent and temporary job vacancies subject to Article 4 – Temporary Full-Time Employees for a period of seven (7) calendar days before any such job is filled. The opinion of the Employer shall not be exercised in an arbitrary or discriminatory manner.

  • JOB VACANCIES Vacancies or new positions shall be awarded to the senior employee applicant where the employee currently possesses the necessary capabilities to perform the work. Qualifications for the job shall be posted by the Employer, and the posting shall include the shift and number of hours for the position. No employee shall be eligible to bid on a job vacancy or new position until the employee has worked in the employee's existing job for a minimum of one hundred eighty (180) days. The provisions of the preceding sentence shall not apply when employees bid on vacancies or new positions in the employee's same classification. All vacancies shall be bulletined for a minimum of five (5) calendar days, and notice of the same furnished to the Union at the same time. Each Hospital shall develop a system to ensure that only applicants signing the posting during the five calendar day posting period will be considered. Temporary assignments may be made during such posting period only; provided assignments to a new classification may be on a temporary basis for ten (10) days. If a question arises as to the capability of an employee to perform the employee's duties after the above herein procedure has been used, that question, and any other question incidental thereto pertaining to the employee's classification and rate of pay, shall be settled by mutual agreement between the Employer and the Union. If such questions cannot be so settled, they shall be settled by arbitration as provided in Article 2. In filling vacancies or new positions, senior employees in the classification where the vacancy or new position is located shall be given preference. In the event that the vacant or new position cannot be filled with a qualified employee from that classification then qualified applicants from other classifications within the bargaining unit will be considered based on bargaining unit seniority.

  • Notification of Vacancies A laid off employee shall be notified by certified mail of an appropriate vacancy, sent to the employee’s address on file in the office of the Executive Director for Human Resources Management. An employee’s failure to respond affirmatively in writing within five calendar days after receipt of the Employer’s letter shall cause loss of recall rights.
