Filling of Positions under the Job Posting Procedure. Where the Hospital is unable to transfer a new employee selected in accordance with the job posting provision, within 30 calendar days of being awarded the position, the Hospital will endeavour to notify the Union Chairperson of the reasons for the delay. LETTER OF UNDERSTANDING #9 – ACCOMMODATION In accordance with the provisions of the Human Rights Code, accommodation is the responsibility of the Employer, the Union and the employee. When it has been medically determined that an employee is unable to return to the full duties of their position due to a disability, the Employer will notify and meet with representatives of the Union to discuss the circumstances surrounding the employee's return to suitable work. The Employer will notify the Union when the employee has accepted suitable work. The Employer will commit to review positions within the bargaining unit for suitable work prior to a review of all vacant positions within the Employer.
