Common use of Filing of Claims Clause in Contracts

Filing of Claims. 4.5 The Guarantee Holder may file a Claim for Expropriation at any time from the Date of Loss to the date 180 days after the applicable Waiting Period has elapsed. The Guarantee Holder shall submit to MIGA promptly all material evidence available to it from time to time as may be necessary to support such Claim for Expropriation, including evidence concerning the cause of the failure to pay the Scheduled Payment when due in accordance with the Loan Agreement and evidence concerning the actions or inactions of the Host Government constituting the Expropriation.

The Guarantee Holder shall submit to MIGA promptly all material evidence available to it from time to time as may be necessary to support such Claim for Expropriation, including evidence concerning including: (a) the cause of the failure to pay receive payment from the Scheduled Payment when due in accordance with the Loan Agreement Project Enterprise of Guaranteed Reimbursement Amounts; and evidence concerning (b) the actions or inactions of the Host Government constituting the Expropriation.

The Guarantee Holder shall submit to MIGA promptly all material evidence available to it from time to time as may be necessary to support such Claim for Expropriation, including evidence concerning the cause audited accounts and financial statements of the failure to pay Project Enterprise in respect of the Scheduled Payment when due in accordance with the Loan Agreement Investment Project and other evidence concerning the actions or inactions of the Host Government constituting the Expropriation.
