Fiber. The City shall, at the sole expense of LMH, oversee the installation of 24 strands of fiber optic cable ("LMH South Fiber") in the Kasold Drive Conduit and the LMH South Conduit. LMH shall own and be responsible for the LMH South Fiber. Costs LMH shall be responsible for all costs of the LMH South Project. The City shall be responsible for hiring K&W Underground to complete the LMH South Project and for overseeing the work. Before the work is completed, LMH will issue to the City a PO in the amount of the estimated cost of the project. At the conclusion of the LMH South Project, the City will pay K&W Underground for its work. If the cost of the work is less than the estimated cost of the project, then the City will refund the balance to LMH. If the cost of the work is more than the estimated cost of the project, then LMH shall reimburse the City, upon the City's invoice, for all costs exceeding the estimate.
Fiber. On the terms and conditions herein and in each Product Order, SRP licenses to Licensee, and Licensee licenses from SRP, the right to use the Fiber specifically described in each Product Order (the “Fiber”) and any equipment described in the Product Order as being licensed to Licensee. All right, title and interest in the Fiber and any Equipment shall at all times remain exclusively with SRP (or with any third party from whom SRP obtains the rights to the Fiber), except for the rights granted to Licensee to use the Fiber and Equipment under this Agreement and the applicable Product Order. Licensee may use the Fiber solely for providing Telecommunications Services, in accordance with applicable laws, rules, regulations, orders and other regulatory requirements, now or later in effect, of any governmental authority having jurisdiction over Licensee, the Fiber or the use thereof. This Agreement and the license granted hereunder are subject to termination or expiration as provided herein, and shall have no force or effect thereafter, except as provided in Section 2.3 (Product Orders) with respect to any Product Order that may continue to remain effective.

Fiber. The fiber reflected on the Metropolitan Access Network maps and the Long Haul Fiber Route maps are all of the fiber used for the conduct of the Business as presently conducted by the Company. All of the fiber owned by the Company is free and clear of any Lien, other than Permitted Liens. The Metropolitan Access Network and the Long Haul Fiber Route comply, and have been maintained and perform, in all material respects, with applicable Bellcore, Underwriters' Laboratory, Network Equipment Building Standards and Electronic Industry Alliance - Telecommunications Industry Association standards or equivalents. All fiber in the Metropolitan Access Network and the Long Haul Fiber Route has been built and installed substantially in accordance with applicable permits and the Metropolitan Access Network and the Long Haul Fiber Route are currently operational.
