Felony Conviction Notice. Before entering into a contract with District, a Contractor must give notice to District if Contractor, an owner or operator of the business, or an employee or agent of the Contractor has been convicted of a felony and/or is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure or an equivalent offense under federal law or the laws of another state by complying with the applicable provision(s) set out below. Contractor must obtain criminal history record information that relates to Contractor or an employee or agent of Contractor if Contractor, an employee or agent is considered to be a “covered employee”. A “covered employee” has or will have continuing duties related to the contracted services and the duties are performed on school property or any other location where students are regularly present and have or will have direct contact with students. The District may terminate this Contract if District determines that Contractor fails to comply with this provision.

Contractor’s failure to provide such notice shall result in a material breach of this Contract. Felony Conviction Notice. Texas Education Code 44.034(a), Notification of Criminal History states, “a person or business entity that enters into a contract with a school district must give advance notice to the district if the person or an owner operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony.” Subsection (b) states “a school district may terminate a contract with a person or entity if the district determines that the person or business entity failed to give notice as required by Subsection (a) or misrepresented the conduct resulting in the conviction. The district must compensate the person or business entity for services performed before the termination of the contract.” This notice is not required of a publicly-held corporation. If notice is required of Contractor, then Contractor shall complete a Felony Certification Form, attached hereto as Exhibit D and incorporated by reference herein.

Felony Conviction Notice. In accordance with the State of Texas Education Code, Section 44.034, Contractor must give advanced notice to the District if the Contractor or an owner of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony. This notice is not required of a publicly-held corporation. Contractor represents and warrants that Contractor has not and Contractor’s employees assigned to District projects have not been convicted of a felony criminal offense, or that, if such a conviction has occurred, Contractor has fully advised the District as to the facts and circumstances surrounding the conviction. The District may terminate an Agreement with the Contractor if the District determines that the Contractor failed to give notice or misrepresented the conduct resulting in the conviction.
