Fees, In General. The City shall pay fees to the Engineer for all services rendered by Engineer in accordance with the terms and conditions of this Contract, subject to the appropriation limits of Article 3 hereof.
Fees, In General. 4.1.1.1. The City shall pay fees to the Engineer as specified in Article 4 for all services rendered by the Engineer in accordance with the terms and conditions of this Contract, but subject to Section 4.2. relating to appropriations made by the City.

If the Consultant receives payment from the City for work performed by any subcontractor or for materials provided by any supplier, and the Consultant withholds payment to the subcontractor or supplier on account of a deficiency in the quality or quantity of the work or materials, the City may withhold a corresponding amount from any pending or future payments to the Consultant until the next regular payment to the Consultant occurring after the City receives reasonable documentation that the deficiency has been remedied.
Fees, In General. Any compensation arrangement described or consented to herein, shall be subject to change at the discretion of Adviser and the written approval of the client. All fees are negotiable and may be reduced, depending on the complexity or the nature of the services. Either party may terminate the Agreement upon thirty (30) days prior written notice thereto. Upon termination, any fees, which the Client has paid to Adviser in advance, may be refunded on a prorated basis.
