Common use of Fee Structure Clause in Contracts

Fee Structure. ‌ Any employee currently employed or hired into the bargaining unit covered by this Memorandum who is not a member of the Union shall, beginning with the third full pay period after individual written notice has been given in accordance with Article 20.13, and until the expiration of this Article, pay to the Union a Fair Share Agency Shop Service Fee for services rendered by the Union. The Service Fee shall be equal to the monthly dues of regular membership, less non-chargeable costs as defined in Article 20.11, and/or by statutory or case law, but in no event to exceed ninety-five percent (95%) of the regular membership dues. The Union shall have the exclusive right to decide and determine whether any such action or proceeding referred to in the above paragraph shall or shall not be compromised, resisted, defended, tried, or appealed, but shall consult with the County prior to making any such decision or determination.
