Fee Increase. The Construction Manager shall not be entitled to additional Fee for delays in the Work caused by the Owner. The Construction Manager may receive additional General Conditions for verifiable increased expenses if delays in the Work caused by the Owner result in a delay of the Final Completion Date, as determined by the Owner.
Fee Increase. The pricing of any fee during any renewal term may increase up to 8% above the applicable pricing in the prior term, unless we provide you notice of different pricing at least 60 days prior to the applicable renewal term.
Fee Increase. Any increase in a Service Fee will be limited by Comdisco to a maximum of six percent (6%) per year per Schedule. Increases are effective on the annual anniversary of the Commencement Date of each Schedule.
Fee Increase. TE shall have the right to increase the recurring service charges set forth in the Service Agreement, upon written notice to Customer (which may be given via Customer invoices), at any time or times after the date service is operative under the Agreement. Customer agrees to notify TE of any objection to such increase in writing within 20 days after the date of the notice of increase, failing which it shall be conclusively presumed that Customer has agreed to such increase. In the event Customer objects to such increase, TE may elect, at its option, to (i) continue the Agreement under the terms and conditions in effect immediately prior to such increase, without notice to Customer, or (ii) terminate the Agreement upon 15 days written notice to Customer.
Fee Increase. On each anniversary of the Effective Date, UST is entitled to increase the rates and fees specified in this Agreement and any SOWs entered into hereunder by the greater of five percent (5%) and the percentage change in the UK Retail Prices Index (or its replacement index from time to time) during the 12-month period immediately preceding the proposed date of increase of such rates or fees.
Fee Increase. Upon expiration of the initial Subscription Term, the then-current list price for the chosen Subscription Type shall apply for each subsequent 12 month renewal term. Customer may request the then-current list price prior to the automatic renewal of the Subscription.
Fee Increase. Luware shall be entitled to increase the fees prior to the beginning of each subsequent Subscription Term in accordance with clause 5.4 above.
Fee Increase. The amount set forth as "Legal Services Fees" in Section 2(a) Administrative of the Agreement is hereby changed from $100,000 to $115,000.

If, during the Term, new laws or regulations are enacted that require Delek-Big Xxxxx to make substantial and unanticipated capital expenditures (other than maintenance capital expenditures) with respect to the Terminal, Delek-Big Xxxxx may increase the Terminalling Service Fee or the Storage Fee, as applicable, to cover the cost of complying with these laws or regulations. Delek-Big Xxxxx and Delek Refining shall use their reasonable commercial efforts to comply with these laws and regulations, and shall negotiate in good faith to mitigate the impact of these laws and regulations and to determine the amount of increase to the Terminalling Service Fee or the Storage Fee. If Delek-Big Xxxxx and Delek Refining are unable to agree, the amount of such fee increases will be determined by arbitration in accordance with Section 29(d).

If, during the Term, new laws or regulations are enacted that require Delek-Big Sandy to xxxx substantial and unanticipated capital expenditures (other than maintenance capital expenditures) with respect to the Facilities, Delek-Big Sandy max xxxrease the Throughput Fees or the Storage Fee, as applicable, to cover the cost of complying with these laws or regulations. Delek-Big Sandy anx Xxxek Refining shall use their reasonable commercial efforts to comply with these laws and regulations, and shall negotiate in good faith to mitigate the impact of these laws and regulations and to determine the amount of increase to the Throughput Fees or the Storage Fee. If Delek-Big Sandy anx Xxxek Refining are unable to agree, the amount of such fee increases will be determined by arbitration in accordance with Section 30(d).
