Fairview Lots. Within thirty days of the Effective Date, the Town shall purchase the Xxxxxx lot or acquire the Xxxxxx lot by eminent domain. Within a ninety (90) days after the Effective Date, the Town shall purchase the Strizver lot or acquire the Strizver lot by eminent domain. The Fairview Lots shall be acquired so that sufficient right-of-way is available for public improvements to the Xxxxxxx Extension at the Fairview Road intersection. The Town shall deed the Fairview Lots to Xxxxxxxxxx, which shall use the Fairview Lots for construction of the Xxxxxxx Extension and for construction of the Fairview Pond. The deed shall provide for reversion to the Town if the Xxxxxxx Extension is not completed within ten (10) years of the Effective Date. Xxxxxxxxxx may retain any portions of the Fairview Lots not needed for Xxxxxxx Extension right- of-way and the detention ponds.

  • TOOL STORAGE 1. A company shall provide on all construction jobs in towns and cities, and elsewhere where reasonably necessary and practicable (or if requested buy the employee), a suitable and secure waterproof lock-up solely for the purpose of storing employees’ tools, and on multi-storey and major projects the company shall provide, where possible, a suitable lock-up for employees’ tools within a reasonable distance of the work area of large groups of employees.

  • Dewatering 4.7.1 Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, all non- trades employees shall assist in ‘dewatering’ their own work site or area if it is so affected. Such work to be paid at single time rates. Productive work will continue in areas not so affected.

  • Cemetery The Local Church agrees and insures that, after the Disaffiliation Date, its cemetery and/or columbarium, will continue to be maintained in substantially the same manner as presently maintained. In addition, Local Church will honor any and all contracts, deeds, and agreements for burial and/or internment in its cemetery or columbarium, as well as insuring and continued access for families and loved ones of United Methodists buried there and for burials in unfilled xxxxxx and columbarium slots (including granting an access easement to the Conference and members of the United Methodist Church for visitations, historical research, and related purposes).

  • SHOPPING CENTRES 1. The general terms and provisions of the VBIA shall apply to “Shopping Centres” (as defined) with the following variations:
