Failure to Occupy. Resident must occupy the assigned space or deliver written notice of delayed arrival to University by 9:00 a.m. on the first day of classes of the first academic term of residency. University on behalf of Provider reserves the right to cancel this Agreement and/or reassign the assigned space to another person if Resident does not comply with this provision. Cancellation by University of behalf of Provider pursuant to this paragraph will not release Resident from the obligation to pay all fees under this Agreement for the entire Term.
Failure to Occupy. If Tenant fails to occupy premises in accordance with this lease, all deposits hereunder shall be automatically forfeited.
Failure to Occupy. The Resident’s failure to occupy the assigned space each semester by 12:00p.m. CT on the first day of classes entitles the University to reassign the Resident to another space and to assign the Resident’s original space to another individual. If Student Housing receives written notification that the Resident’s arrival will be delayed, the University will, within reason, hold the original assignment for the Resident. Failure to occupy an assigned space does not constitute a release from the housing contract with the University.
Failure to Occupy. Unless prior written arrangements have been made with RL for late arrival, failure of Resident to take Occupancy by 10PM on the second day of classes of each Semester will result in termination of the License and Resident will be charged a fee of $700.

If the Licensee shall abandon the bedroom and/or premise voluntarily or involuntarily, the same may be re- licensed by Agent for such fee and upon such terms as Agent in its discretion may deem reasonable and advantageous; and, in the event of such re-licensing, the Licensee shall be and remain liable for any deficiency in License fees, expenses incident to such re- licensing, and damages which Agent may sustain by virtue of the License’s abandonment. In the event of a Licensee’s abandonment of the bedroom and/or premises or failure of a licensee to begin its use, Agent shall have the sole and exclusive right to assign a new licensee to the premises. Agent has no obligation to obtain permission from Licensee to assign a new license to the premises, nor does Agent have any obligation to obtain permission from Licensee to assign a new licensee to the premises, nor does Agent have any obligation to inform Licensee of any new licensee assignment or move in. Examples of Abandonment of premise include, but are not limited to, return of keys, written cancellation request or failure to check in within seven days of the Term Commencement Date.
Failure to Occupy. If the student fails to occupy assigned housing by 8:00 a.m. on the second day of classes of any semester, the student shall forfeit the security deposit and agrees to pay for room occupancy for the remainder of the effective academic year.
