Facilities Construction. Any improvements or transportation facilities, including sawmills, buildings, bridges, roads, etc., constructed by the PURCHASER in connection with this sale and within the sale area or on other State land leased for the purpose, must be done in accordance with standard or special plans approved by the STATE. Bonding may be required on each improvement. The STATE neither expressly nor implicitly warrants its improvement estimates. Estimates will be made for the sole purpose of establishing the minimum bid, and are not to be used for other purposes.

Facilities Construction. The Facilities shall be constructed by the Landowner in accordance with the plans and specifications for the development as contained in the attached site plan. Facilities Construction. The Phase 1 Commencement of Construction shall occur no later than October 31, 2015. Without prejudice to any other remedy available to the City, the Overdue Rent shall be due and payable in full by November 1, 2015 if the Phase 1 Commencement of Construction does not occur by October 31, 2015. In such event, the City may in its sole discretion terminate this Agreement effective immediately, without opportunity to cure, and without recourse by Concessionaire, if payment in full of the Overdue Rent is not remitted by November 1, 2015.

Adequate maintenance is herein defined as follows: 1) keeping the Facilities in good working condition so that the Facilities are performing their design functions, 2) performing facility inspections and repairs as may be needed, and 3) replacing and/or modifying portions, or all of the system, as may be needed to maintain the intended function of the facility.
