Expiration of Sick Leave. Employees who have unused sick leave credits after the one hundred and eighty (180) day waiting period when the long term disability benefit becomes payable shall either exhaust all such sick leave credits before receiving the long term disability benefit, or bank the unused sick leave credits for future use. Employees who will be eligible for benefits under the Long Term Disability Plan shall not have their employment terminated. Following expiration of their sick leave credits, they shall be placed on unpaid leave of absence until receipt of long term disability benefits. Upon return to work following recovery, an employee who was on long term disability shall, where possible, return to his/her former job, exercising his/her seniority rights if necessary, pursuant to Article 13.02 D), of the Collective Agreement.

Expiration of Sick Leave. An employee absent because of illness, who has utilized all available sick leave, will be continued on the basis of a leave of absence without pay until she/he is able to return to work, but not to exceed sixty (60) days beyond the date when her/his sick leave was exhausted. Such an employee shall furnish to the human resources administrator a doctor's certificate attesting to the fact that the employee is able to return to work. An extension beyond the above sixty (60) days will be considered by the human resources administrator in the case of an employee who has been in continuous employment with the Board for a period of five (5) years or more. In such extensions of sick leave on the basis of leave without pay, the employee will be offered her/his original position. After one (1) year of extension beyond the date when the employee's sick leave was exhausted, the employee will be placed on the recall list for one (1) year only. As vacancies occur similar to the employee's former position, the employee on the recall list will be offered these positions. Failure to accept the position will result in removal from the recall list.
Expiration of Sick Leave. When an employee becomes physically or mentally incapacitated for the performance of the duties of their position and does not request transfer to a position of lower grade, or are physically or mentally incapacitated for the performance of the duties of their position, they shall be granted a disability leave or medical related personal leave of absence without pay, provided the disability continues beyond the accumulated paid leave balances and provided the established procedures are followed.
