Expert witness testimony. City has not yet determined whether it will be necessary to call any member of Consultant’s firm as an expert witness as a result of the investigative review. To the extent that City requests Consultant to reach conclusions or form opinions, Consultant is obligated to give City, Consultant’s best independent judgment without regard to the impact that such conclusions or opinions may have upon the investigative review. Consultant has not made and will not make any guarantees regarding the nature or admissibility of its opinions or the outcome of any legal proceeding.

Consultant agrees that its key Consultant personnel shall assist the City as expert witnesses in any administrative or civil litigation in which the subject matter of the Work is relevant. This assistance shall be under the direction of the City’s legal counsel or such other counsel as the City may employ in conjunction with the Suppliers. The City may designate Consultant key personnel as testifying or non-testifying experts and may assert the attorney work product privilege as to the Work during the period of such litigation.
