Expansion Space Commencement Date. The Expansion Space Commencement Date shall be the date on which the work to be performed pursuant to Section 2 above is substantially completed except for items of work and adjustment of equipment and fixtures that can be completed after the Expansion Space is occupied without causing substantial interference with Tenant’s use of the Expansion Space (i.e., “punchlist” items) as reasonably determined by the Architect using its reasonable independent professional judgment, and all necessary governmental approvals permitting Tenant’s use and occupancy of the Expansion Space have been issued, which date the parties expect will be on or about August 1, 2004 (the “Anticipated Expansion Space Delivery Date”). In the event that the Expansion Space Commencement Date fails to occur by the Anticipated Expansion Space Delivery Date by reason of construction delays or otherwise, then this Amendment shall nevertheless continue in full force and effect, and Tenant shall have no right to rescind, cancel or terminate the same if possession is given within one hundred twenty (120) days thereafter (which period shall be extended for delays resulting from matters beyond Landlord’s reasonable control). In the event that Landlord is unable to deliver the Expansion Space to Tenant on the Anticipated Expansion Space Delivery Date, Tenant agrees that in no event shall Landlord be liable for damages, if any, sustained by Tenant as a result of Landlord’s failure to deliver possession by such date. On the Expansion Space Commencement Date or such later date as Landlord may request, Tenant shall promptly enter into a supplementary written agreement (the “Expansion Space Commencement Agreement”), in substantially the form attached as Exhibit “D”, thereby specifying the date as of which the Expansion Space Commencement Date occurs. The parties acknowledge and agree that the Anticipated Expansion Space Delivery Date is based on (a) Tenant meeting each and every of the following deadlines (the “Tenant Deadlines”): (i) execution of this Amendment by April 23, 2004; (ii) approval of the Space Plan by May 7, 2004; and (iii) approval of the Plans and Specifications by May 28, 2004, and (b) Landlord meeting each and every of the following deadlines (the “Landlord Deadlines”): (i) delivery of the proposed Space Plan to Tenant within eleven (11) calendar days after Tenant’s execution of this Amendment; and (ii) delivery of the proposed Plans and Specifications to Tenant with eighteen (18) calen...
Expansion Space Commencement Date. The commencement date with respect to the applicable Expansion Space (“Expansion Space Commencement Date”) shall be the earlier to occur of (i) the first day after the Pre-Term Build-Out Period with respect to such Expansion Space, and (ii) the date Tenant opens for business for the Permitted Use in the whole or any part of such Expansion Space.
Expansion Space Commencement Date. (a) Landlord delivered possession of Portion A to Tenant on May 2, 2001.
Expansion Space Commencement Date. Effective as of the date that Landlord delivers possession of the Expansion Space to Tenant in the condition required herein (the “Expansion Commencement Date”) the Premises shall be deemed to include the Expansion Space such that the Premises shall consist of approximately 7,248 rentable square feet. The term of the Lease for the Expansion Space shall run coterminous with the term of the Lease for the Existing Space, such that the Lease shall expire as of December 10, 2021. The anticipated Expansion Commencement Date is October 1, 2017; provided that if Landlord is unable to deliver possession of the Expansion Space on the anticipated Expansion Commencement Date, Landlord shall have no liability to Tenant for delay in delivering possession.
Expansion Space Commencement Date. If Landlord has not constructed Qualifying Improvements in the Expansion Space or leased the Expansion Space to an Interim Tenant, Landlord shall deliver the Expansion Space to Tenant on or about the first day of the 33rd month of the Term. The date on which the Landlord delivers possession of the Expansion Space to Tenant with the appropriate Expansion Space Delivery Condition fully satisfied is referred to herein as the “Expansion Space Commencement Date”. The Expansion Space shall become a part of the Premises for all purposes on the Expansion Space Commencement Date, except as set forth below.
Expansion Space Commencement Date. The definition of Expansion Space Commencement Date, as set forth in the First Amendment, is hereby amended to read in its entirety as follows:
Expansion Space Commencement Date. The term of the Sublease as to the Expansion Space (the "Expansion Space Term") shall commence on the later of (i) May 1, 2007, or (ii) the date the Master Landlord delivers its written consent to the Amendment to Sublandlord (the "Expansion Space Commencement Date"), and shall expire on the Expiration Date. Commencing on the Expansion Space Commencement Date, all references to the term "Term" in the Sublease shall be deemed to include and refer to the Expansion Space Term. Upon receipt of the Master Landlord's written consent to this Amendment, Subtenant shall have the right to early occupancy of the Expansion Space upon all of the terms and conditions of the Sublease, except that Subtenant shall not be required to pay Base Rent on the Expansion Space until the Expansion Space Commencement Date.
Expansion Space Commencement Date. August 1, 1997 pursuant to Section 1.5 of the Lease.
Expansion Space Commencement Date. The Term of the Lease for the Expansion Space and Tenant’s obligation to pay Fixed Rent and additional rent for the Expansion Space shall commence on the date of November 1, 2018 (the “Expansion Space Commencement Date”)
Expansion Space Commencement Date. December 1, 1999, or upon substantial completion of tenant improvements, unless construction delays are caused by Tenant, whichever is latter. Except as provided under Section 12 of this Fourth Amendment, if Tenant occupies and does business from any portion of the Expansion Space before the Expansion Space Commencement Date, the Expansion Space Commencement Date shall be advanced to the date of such occupancy.
