Expansion of Operations. (a) Adjoining Over-The-Road and Local Cartage NO CHANGE
Expansion of Operations. A. The parties agree that newly-established terminals and consolidation of terminals which are controlled and utilized as part of a current operation within the Denver Metro Area will be covered by this Local Rider. In connection with this section, and in recognition of the applicable requirements of this Local Rider, the term Denver Metro Area will refer tothe following locations that, all of which have historically been operated as sub segments of the Denver operation will be regarded as Denver spin-offs should new facilities be opened there: Grand Junction, Glenwood Springs, Aspen, Vail, Rifle, Steamboat Springs, Xxxxxx, and Castle Rock.

The parties agree that newly-established terminals and consolidation of terminals which are controlled and utilized as part of a current operation will be covered by this Agreement. Expansion of Operations. (a) Adjoining Over-The-Road and Local Cartage It is understood and agreed that the provisions of the National Master Freight Agreement shall be applied, without evidence of union representation of the employees involved, to all subsequent additions to, and extensions of, current over-the-road or local cartage operations which adjoin and are controlled and utilized as part of such current operations of the signatory Employer, or any other entity, not operated wholly independently of the signatory Employer within the meaning of Article 3, Section 1 (a). In this regard, the parties agree that newly-established terminals and consolidations of terminals which are controlled and utilized as part of a current operation will be covered by the National Master Freight Agreement and applicable Over-the-Road and Local Cartage Supplemental Agreements.

Expansion of Operations. New Pick-Up and Delivery Adjoining Current Operations It shall not, however, be a violation of this Article if, during the term of this Agreement, an Employer commences pick-up and delivery operations which adjoin and are controlled and utilized as part of such current operations with other than its own employees when there is insufficient business to economically justify the establishment of its own employer-operated pick-up and delivery service. However, the above exception shall thereafter terminate when sufficient economic justification develops so as to warrant the establishment and maintenance of the terminal operation by such Employer, in which event, the Employer shall institute a pick-up and delivery operation or continue such operations with companies which maintain wage standards established by this Agreement in the area where the work is conducted. This exception shall not apply in any circumstance where an Employer is presently engaged in pick-up and delivery operations either through his/her own terminal or through companies which maintain such wage standards.
