Expansion of Capacity. The Utility will take reasonable steps, at Licensee’s sole expense, to expand Pole Capacity when necessary to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require the Utility to install, retain, extend or maintain any Pole for use when such Pole is not needed for the Utility’s service requirements.

Such new facilities are referred to herein as “Expansion Facilities”, and may include, in CIWW’s discretion, facilities constructed or installed to increase the capacity of the WDMWW Designated Water Supply Facilities. WDMWW shall cooperate and assist CIWW in planning for and constructing any Expansion Facilities that affect the WDMWW Designated Water Supply Facilities.

Expansion of Capacity. Utility will expand pole capacity for Utility Poles, at Licensee’s expense, when necessary to accommodate Licensee’s Wireless Attachment approved pursuant to the issuance of a Permit, and when consistent with local governmental land use requirements of general applicability and all applicable Laws and Engineering Standards. Notwithstanding the foregoing sentence, Utility is under no obligation to install, retain, extend, or maintain any Pole for the benefit of Licensee when such Pole or system of Poles is not needed for Utility’s core electric or customer service requirements.
Expansion of Capacity. Unless the subject Pole is excluded from joint use, Owner Utility will expand Pole Capacity within a reasonable time when necessary to accommodate Attaching Utility’s request for Attachment, such that subject Pole meets the requirements of a Standard Utility Pole, such expansion or replacement shall be at the Attaching Utility’s expense, as adjusted in accordance with Section IX A. At Owner Utility’s discretion, Owner Utility may rearrange or reconfigure its Attachments on subject pole in lieu of pole replacement as long as the Attaching Utility’s Assigned Space can be accommodated. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require Owner Utility to install, retain, extend, or maintain any Pole for use when such Pole is not needed for Owner Utility's service requirements.
