Common use of Executive Clause in Contracts

Executive. Executive’s rights and obligations under this Agreement shall not be transferable by Executive by assignment or otherwise, without the prior written consent of the Company; provided, however, that if Executive shall die, all amounts then payable to Executive hereunder shall be paid in accordance with the terms of this Agreement to Executive’s devisee, legatee, or other designee, or if there be no such designee, to Executive’s estate.

Executive. Executive’s 's rights and obligations under this Agreement shall not be transferable by Executive by assignment or otherwise, without the prior written consent of the Companyand any purported assignment, transfer or delegation thereof shall be void; provided, however, that if Executive shall die, all amounts then payable to Executive hereunder shall be paid in accordance with the terms of this Agreement to Executive’s 's devisee, legatee, legatee or other designeedesignee or, or if there be no such designee, to Executive’s 's estate.

Executive’s rights and obligations under this Agreement shall not be transferable by Executive by assignment or otherwise, without the prior written consent of the Company; provided, however, except that if Executive shall diemay assign benefits payable in the event of Executive death under Section 7(b) of this Agreement to a trust of which he is the sole beneficiary during his lifetime. In the event of Executive’s death, all amounts then payable to Executive hereunder under this Agreement shall be paid in accordance with the terms of this Agreement to Executive’s devisee, legatee, trust, or other designee, or if there be no such designee, to Executive’s estate.

In the event of Executive’s death, all amounts then payable to Executive hereunder under this Agreement shall be paid in accordance with the terms of this Agreement to Executive’s devisee, legateeDesignated Beneficiary, or other designeeif the Designated Beneficiary predeceases Executive to the secondary Designated Beneficiary, or if there be is no such designeeliving Designated Beneficiary so specified by the Executive, to Executive’s estate.
