EXECUTION AND EFFECTIVE DATE. Separate copies of this document shall constitute original documents which may be signed separately but which together will constitute one single agreement. This Agreement will not be binding on any party, however, until, at a minimum, it is signed by all parties or their representatives. In addition, this Agreement shall become effective and binding on the eighth day following Xxxxxx’x execution of this Agreement.

This Agreement shall be deemed effective as of the Grant Date upon the delivery to the Employee of the Award Certificate hereto (or information contained therein), by electronic or other means of transmission, and such effectiveness shall not require any counterpart signature of the Employee.

EXECUTION AND EFFECTIVE DATE. This Agreement shall take effect upon the effective date of a license issued by the FERC consistent with this Agreement. If the FERC issues a new license inconsistent with this Agreement and if a Party appeals, the Agreement shall not go into effect. The Parties retain the right to appeal the issuance of a license in whole or in part if unacceptable provisions are added, including stay of any provision.
