Subject to the Party affected by the Delay Event giving the notice required in Section 15.2(a), a Delay Event shall excuse the Party affected by the Delay Event from whatever performance is prevented by the Delay Event referred to in such notice for such appropriate number of days as the Authority and the Lessee jointly determine, each acting reasonably. If the Authority and the Lessee cannot agree upon the period of delay, then either Party shall be entitled to refer the matter to the dispute resolution procedure in Article 19. This Section 15.2(b) shall neither (i) excuse the Lessee from the performance and observance under this Agreement of any obligations and covenants not affected by the Delay Event nor (ii) prevent any of the Authority or its Representatives (or their respective designee) from exercising its rights under Section 3.7. Notwithstanding the occurrence of a Delay Event, the Party affected by the Delay Event shall continue its performance and observance under this Agreement of all of its obligations and covenants to the extent that it is reasonably able to do so and shall use its Reasonable Efforts to minimize the effect and duration of the Delay Event. Except as contemplated in the definition of Delay Event, nothing herein shall permit or excuse noncompliance with a change to applicable Laws.

The following absences are excused but count towards the 10-day limit for school policy purposes: - Personal student illness-must be verified by a parent - Family emergency-must be verified by a parent - Personal absence-must be verified by parent & approved by an administrator Unexcused: The following are unexcused absences that count toward the 10-day limit policy: - Truancy, Cutting Class, Oversleeping, Car Trouble, Failure of parent to verify absence, Working, Missing bus due to the fault of the student, Hair Appointments, Senior Pictures Exempt: Exempt absences are excused absences that do not count toward the 10-day limit. The following are examples of exempt absences: - Absences for which student is under a Doctor’s care. A Doctor’s signed notice is required. - Funeral for members of the household or immediate family (with prior approval). - Absences that have unique or extenuating circumstances which must be approved by the principal or assistant principal. - Court Summons - Trips by students with parents that are PRE-APPROVED and determined to be educational by the school. - Seniors—Two college visit, pre-approved by the Guidance Office with verification from school visited by end of April. Cannot take college visit if student exceeds the 10-day attendance limit. - Juniors—One college visit, pre-approved by the Guidance Office with verification from school visited by the end of April. Cannot take college visit if student exceeds the 10-day attendance limit. POLICY In order for students to successful in their academics, it is necessary for them to be in attendance EVERY SCHOOL DAY as prescribed by the school attendance law. For those students who have an absence or tardy, the following procedures will be followed:
