Common use of Exchange of Warrant Certificates Clause in Contracts

Exchange of Warrant Certificates. Warrant certificates may be exchanged for another certificate or certificates entitling the Holder thereof to purchase a like aggregate number of Warrant Shares as the certificate or certificates surrendered then entitle such Holder to purchase. Any Holder desiring to exchange a Warrant certificate shall make such request in writing delivered to the Warrant Agent, and shall surrender, properly endorsed in the manner described in subsection 3.1 hereof, the Warrant certificate or certificates to be so exchanged. Thereupon, the Warrant Agent shall countersign and deliver to the person entitled thereto a new Warrant certificate or certificates, as the case may be, as so requested.

Thereupon, the Warrant Agent shall countersign and deliver to the person entitled thereto a new Warrant certificate or certificates, as the case may be, certificates as so requested, which certificate or certificates will be in the same form as the original certificate or in such other form as may be approved by the Company and the Warrant Agent.
