Excessive Dredging. Dredging performed below the allowable over depth or otherwise outside the permitted dredging template. Excessive Dredging volume will be deducted from the total volume dredged and payment will not be made for Excessive Dredging.

Excessive Dredging. Excessive dredging is defined to be any dredging which is in excess of the Required Bottom Depth, as shown on the contract drawings and listed in Appendix A, Acceptance Reach and Dredge Required Bottom Depth. Any material removed below the Average Required Bottom Depth will not be measured for payment. The Average Required Bottom Depth shall be calculated by averaging two adjacent 50 feet Station depths. ANY MATERIAL REMOVED IN EXCESS OF ONE (1.0) FOOT BELOW THE AVERAGE REQUIRED BOTTOM DEPTH SHALL INCUR AN “EXCESSIVE DEPTH PENALTY” OF FIVE DOLLARS ($5.00) PER CUBIC YARD, which shall be deducted from Contractor payments. Example (1) - If the Required Bottom Depth is 6.0 feet below mean low water (MLW) and the Contractor dredges to 8.5 feet MLW at Channel 3A Station 2+00 and 6.5 feet MLW at Channel 3A Station 2+50 the average depth between the Stations is 7.5 MLW. The Contractor will incur the Excessive Depth Penalty equal to the ((average of the Station depths, ((8.5+6.5)/2)=7.5 minus the Required Bottom Depth,6.0) multiplied by the width of the Channel, 36 feet; multiplied by the length between the Stations, 100 feet); divided by 27) multiplied by $5.00. Excessive Depth Penalty = (((((8.5+6.5)/2)-6.0)*36*100)/27)*$5.00= $1000.00. Example (2) – Assume all of the variables are the same as in Example (1) except Channel 3A Station 2+00 is dredged to 7.5 MLW. The Average Required Bottom Depth is ((7.5+6.5)/2)=7.0 MLW subtract 6.0 MLW = 1.0 feet. The Average Required Bottom Depth is not greater than one (1.0) foot therefore the Contractor does not incur the Excessive Depth Penalty. The side slope allowances are described in the previous paragraph. The Contractor shall be responsible for damages caused by excessive dredging.
Excessive Dredging. Material taken from beyond the limits specified in the Task Order will be deducted from the total amount dredged as excessive overdepth dredging, for which payment will not be made.
