Examples of Management Rights. The sole and exclusive rights of the University include, but are not limited to, the rights to: Plan, direct and control all operations and services of the University, including its mission, budget, strategic direction, service levels, staffing levels and resource requirements; Develop, interpret, amend and enforce written policies (applicable to all campuses), procedures, and rules governing the University and the workplace; Determine the methods, means, and organization by which University operations and services shall be undertaken and accomplished; Discipline or discharge faculty members during the term of their appointment for just cause; Assign work in a manner consistent with this Agreement; Schedule courses and alter course schedules;‌ Establish the duties and responsibilities of faculty and other employees; Establish and implement policies and procedures for evaluating the performance of faculty consistent with this Agreement; Establish, modify, and manage the University’s programs and offerings; Determine the kind and location of facilities and equipment, and install, maintain, remove and retire such facilities or equipment; Plan and implement any reductions in force, including the determination of the reason for any reduction in force and the identification of the specific position(s) affected by a reduction in force; Recruit, hire and promote faculty based on standards established by the University; and Perform all other functions that do not conflict with this Agreement.

  • Client Rights The Employer and the Union are committed to quality care of clients. It is the right of clients, in the privacy of their home, to choose the employee with whom they feel the most comfortable. The Employer support client rights. If a client wishes to change employees, for any reason, the Employer will respect the right of the client to do so. If a client chooses to change employees, the employee who is being unscheduled shall be eligible for another client(s) or equivalent hours as available. The Employer will make a good faith effort to provide support for a successful employee/client relationship(s). At the discretion of the parties, the Employer and the Union may explore through the Labor Management Committee methods of coaching, counseling or mediation to assist in the resolution of client/worker conflicts to help ensure consistent service delivery with minimal worker reassignment.

  • Variation of Management Agreement The State and the Company agree to vary the Management Agreement by:-

  • Solicitations for Subcontracts, Including Procurement of Materials and Equipment In all solicitation, either by competitive bidding or negotiation, made by the Contractor for work to be performed under a subcontract, including procurement of materials or leases of equipment, each potential Subcontractor or supplier shall be notified by the Contractor of the Contractor’s obligations under this Agreement and the Regulations relative to non-discrimination on the grounds of race, color, or national origin.
