Equipment Lease. “Equipment Lease” means a personal property lease covering any item(s) of FF&E identified as such in the schedule attached hereto as Exhibit L.

Equipment Lease. Tenant shall not enter into any equipment lease that is not a capital lease for equipment having a fair market value exceeding U.S.$50,000, or annual lease expense exceeding U.S.$50,000, without the prior written consent of Landlord, and all such Equipment Leases shall expressly authorize a turnover to Landlord or its designee of such equipment and Equipment Lease pursuant to the terms of the Turnover Agreement. Tenant agrees to turn over delivery of such equipment to Landlord or its designee in good operating condition and repair at the termination of this Lease. The dollar limits in this Section 4.7 shall increase annually by 3%, compounded annually.
Equipment Lease. Seller has provided Buyer with a true and complete copy of the Equipment Lease and all amendments thereto. As of the Effective Date, no party to the Equipment Lease has issued notice that any other party thereto is in default in the performance of its obligations under the Equipment Lease, and the Equipment Lease is in full force and effect.

Equipment Lease. Contemporaneously with the execution of this Lease, Tewel Corporation ("Tewel") and Tenant have entered into that certain Equipment Lease (the "Equipment Lease") providing for the lease by Landlord and Tewel to Tenant of all furniture, fixtures, trade fixtures, equipment, machinery, tools, and other personal property therein described (collectively, the "Equipment") located on and used in connection with Premises. It is intended that this Lease be coterminous with the Equipment Lease. Any termination of this Real Property Lease shall automatically be deemed to effect a termination of the Equipment Lease.

Equipment Lease. In addition to the other services referred to in this Agreement, we may rent Equipment to you for the sole purpose of use in connection with the Broadband Services. The term of the Equipment lease and use will be the longer of 12 months or coterminous with the Broadband Services term and any extensions thereof; you will be deemed to have accepted the items five (5) days after each is delivered and installed, unless you notify us in writing to the contrary. You may return any defective Equipment to us for a replacement as long as it has not been misused or damaged by you, your agents or invitees. Furthermore, you shall be responsible for ensuring that any Company Equipment is maintained in a secure location, and you shall be fully liable for any and all costs and charges associated with damage to or loss of Company Equipment: i If you are not in default under this Agreement, your End of Contract (“EOC”) options for Equipment are: (a) to automatically renew the term for your other services including the Equipment; (b) purchase the Equipment for its/their then fair market value from Company or one of its vendors.; or (c) return the Equipment. You must give us thirty (30) days prior written notice of your EOC option choice. Under option (b), upon receipt of all amounts due for the purchase of the Equipment, clear title will be transferred to you on an “As Is, Where Is” basis. ii If you elect to return Equipment to us upon expiration of your contract, you must notify us in writing of your intent at least thirty (30) days prior to contract expiration and you must return the Equipment to us immediately upon the EOC. The Equipment must be in good condition and working order, reasonable wear and tear expected (“Good Working Order”). We reserve the right to recover full reimbursement from you for the reasonable cost and expense incurred by us to restore such Equipment to Good Working Order. You will return the Equipment to a location in the United States designated by us. You are responsible for any costs associated with de- installation, packing, proper content labeling and return of the Equipment. Prior to return of Equipment, you are responsible for removing all your information and data, including programs not licensed to the Equipment. We have no obligation to remove your information or any other party’s information from any Equipment. The return of Equipment shall constitute a full release by you of any leasehold rights or possessory interest in the Equipment.
Equipment Lease. The terms of this Appendix B shall be the supplemental terms and conditions (“STCs”) to the General Terms and Conditions for Indirect Procurement (“GTCs”) between Buyer and Supplier and apply to the lease of capital/manufacturing equipment together with all substitutions, replacements, repairs, parts, and attachments thereto, (“Equipment”) and services related to the production, calibration and/or installation thereof (“Services”).
