EQUAL OPPORTUNITY/NON-DISCRIMINATION. A. During the performance of this Agreement, SUBCONTRACTOR shall not unlawfully discriminate, harass or allow harassment, against any employee or applicant for employment because of sex, race, color, ancestry, religion, creed, national origin, physical disability (including HIV and AIDS), mental disability, medical condition (cancer and genetic characteristics), age (over 40), marital status, denial of family care leave, sexual orientation, gender, gender expression, political affiliation, position in a labor dispute, or any characteristic listed or defined in §11135 of the Government Code or any characteristic that is contained in the prohibition of hate crimes set forth in subdivision (1) of §422.6 of the California Penal Code, or any other status protected by law is strictly prohibited. SUBCONTRACTOR shall ensure that the evaluation and treatment of their employees and applicants for employment are free from such discrimination and harassment.

EQUAL OPPORTUNITY/NON-DISCRIMINATION. SUBRECIPIENT shall comply with the requirements of all applicable federal, state and local laws, rules, regulations, ordinances and executive orders prohibiting and/or relating to discrimination, as amended and supplemented. All of the aforementioned laws, rules, regulations, and executive orders are incorporated herein by reference.

The parties agree to comply with all applicable Federal laws and executive orders pertaining to non-discrimination and equal opportunity employment. The Company agrees to post, in conspicuous places available to Employees and applicants for employment, notices provided by the appropriate Contractual regulatory agencies setting forth the provisions of the Equal Opportunity requirements. The provisions of this Article will not operate to violate any other term or condition of this Agreement. The Company and Union agree not to discriminate against an Employee because of the exercise of the rights granted by Section 7 of the National Labor Relations Act, as amended.

The Grantee shall comply with Section 503 of the Rehabilitation Act of 1973, as amended (29 USC 794), pertaining to the prohibition of discrimination against qualified handicapped.
