Equal Consideration. Except as set forth in this Agreement, no consideration has been offered or paid to any person to amend or consent to a waiver, modification, forbearance or otherwise of any provision of any of the Transaction Documents.
Equal Consideration. Except as otherwise set forth herein, no consideration has been offered or paid to any person to amend or consent to a waiver, modification, forbearance, exchange or any other action with respect to any provision of the Note Portion.
Equal Consideration. Subject to section (iii) below, upon the consummation of the Transaction, all of the holders of Preferred Shares will receive the same form and amount of consideration per Preferred Share, respectively, taking into account any liquidation preference to which the holders of Preferred Shares are entitled, and if any holders of Preferred Shares are given an option as to the form and amount of consideration to be received, all holders will be given the same option.

The District together with CSEA believes that our current employees are valuable resource pool for potential promotions and intends to offer advance opportunities to our employees. Bargaining unit members shall be given equal consideration in filling any bargaining unit job vacancy which would represent a promotion, the unit member must notify the District of their interest in the position in accordance with District application procedures.
Equal Consideration. The Company has complied with Section 4.14 of the Purchase Agreement and has provided each holder of the 2012 Debentures only with the consideration set forth in this Agreement.
