Environmental Protection Requirements. Tenant is responsible for constructing and maintaining Tenant’s facilities and conducting Tenant’s operations in a manner that employs all reasonable means to limit the potential for environmental contamination of the Land and adjoining lands. This Article is to be read in harmony with other Articles of this Lease. When the terms and conditions of this Article are more restrictive than other Articles that could be construed to encompass the same topic, this Article shall control. Further, this Article shall be broadly interpreted so as to protect the environmental integrity and condition of the Land and to require compliance with Legal Requirements as to the Land under all circumstances.
Environmental Protection Requirements. If the Products supplied by the Supplier (including the parts and materials thereof) involve any environmental protection requirements, such Products shall have the test report issued by a third party testing institution accepted by both Parties, and shall comply with the environmental protection requirements formulated by the Customer (the latest version of such environmental protection requirements is available at ZTE’s supply chain website: xxxxx://xxxxxx.xxx.xxx.xx/, and any version otherwise provided shall be invalid). Environmental Protection Requirements. Lessee shall strictly comply with all Environmental Laws [ML]. Lessee is responsible for any costs incurred in effecting such compliance regarding this Lease and for securing all necessary permits for any activity approved under the terms of this Lease [ML]. Environmental mitigation measures required by any Governmental Authority having regulatory jurisdiction over the Leased Premises shall be strictly adhered to by Lessee [ML].
Environmental Protection Requirements. The Contractor shall identify applicable Federal, State and Local laws, regulations, and Project specific orders or agreements and perform all work in accordance with said authorities. The Contractor shall ensure that all activities performed by its personnel, subcontractors and suppliers are executed in accordance with said authorities. Any incident of noncompliance noted by the Contractor shall immediately be brought to the attention of the USACE’s KO, COR, and PM via telephone, followed by written notice. Nothing in this PWS shall relieve the Contractor of its responsibility to comply with applicable laws and regulations. The Contractor shall investigate the requirements for and obtain all permits, licenses, approvals, and/or certificates necessary to accomplish the work specified. When the work to be performed requires clearances, such as digging or drilling permits, the Contractor shall obtain such clearances and/or permits, with the assistance of the facilities/site point of contact, prior to initiation of any drilling or excavating operations. The Contractor shall coordinate all excavating with USACE prior to performing work. Contractors on environmental sites are required to perform their own utility checks. The Contractor shall comply with all USACE or site-specific time and procedural requirements (federal, state, and local) described in the permits obtained. The USACE will continue to independently review Contractor work to ensure compliance with all applicable requirements. The Contractor shall perform all work in a manner that minimizes the pollution of air, water or land and develop contingency measures for cleanup of any spills that may occur during performance of this contract. The Contractor shall control noise and dust within reasonable limits or limits established by applicable federal, state, and local laws and regulations. A site survey may be required to identify any wetlands, endangered species, special habitat or other protected areas. Task Orders may include specific environmental protection requirements. Sustainability Requirements The Contractor shall review EO 13834 “Efficient Federal Operations” dated 17 May 2018. The Contractor shall control noise and dust within reasonable limits or limits established by applicable federal, state, and local laws and regulations. The Contractor shall also utilize green and sustainable remediation practices in all aspects of the task order and project execution, as applicable.

Also, provide environmental protective measures required to correct conditions, such as oil spills or debris that occur during the dredging operations. Comply with Federal, State, and PCCA Specification Section 01 35 21, “Pollution Prevention”, pertaining to water, air, and noise pollution. The dredging conditions specified and indicated describe conditions which are known. However, the Contractor is responsible for other conditions encountered which are not unusual when compared to the conditions recognized in the dredging business as usual in dredging activities such as those required under this contract.
