Tenant is responsible for constructing and maintaining Tenant’s facilities and conducting Tenant’s operations in a manner that employs all reasonable means to limit the potential for environmental contamination of the Land and adjoining lands. This Article is to be read in harmony with other Articles of this Lease. When the terms and conditions of this Article are more restrictive than other Articles that could be construed to encompass the same topic, this Article shall control. Further, this Article shall be broadly interpreted so as to protect the environmental integrity and condition of the Land and to require compliance with Legal Requirements as to the Land under all circumstances.

Environmental Protection Requirements. Lessee shall strictly comply with all Environmental Laws [ML]. Lessee is responsible for any costs incurred in effecting such compliance regarding this Lease and for securing all necessary permits for any activity approved under the terms of this Lease [ML]. Environmental mitigation measures required by any Governmental Authority having regulatory jurisdiction over the Leased Premises shall be strictly adhered to by Lessee [ML].
