Common use of Environmental Inspections Clause in Contracts

Environmental Inspections. The inspections under Section 4.3.1 may include Phase I environmental inspections of the Real Property, but no Phase II environmental inspections shall be performed without the prior written consent of Seller not to be unreasonably withheld, and if consented to by Seller, the proposed scope of work and the party who will perform the work shall be subject to Seller's review and approval. At Seller's request, Buyer shall deliver to Seller (at no cost to Seller) copies of any Phase I, Phase II or other environmental reports conducted by Seller on the Real Property.
