Common use of Environmental Events Clause in Contracts

Environmental Events. The Borrower will promptly give notice to the Banks (i) of any violation of any Environmental Law that the Borrower or any of its Subsidiaries reports in writing or is reportable by such Person in writing (or for which any written report supplemental to any oral report is made) to any federal, state or local environmental agency and (ii) upon becoming aware thereof, of any inquiry, proceeding, investigation, or other action, including a notice from any agency of potential environmental liability, of any federal, state or local environmental agency or board, that has the potential to materially affect the assets, liabilities, financial conditions or operations of the Borrower or any of its Subsidiaries, or the Agent's security interests pursuant to the Security Documents.

Environmental Events. The Borrower will promptly give notice to the Banks Agent (i) of any violation of any Environmental Law that the Borrower or any of its Subsidiaries reports in writing or is reportable by such Person in writing (or for which any written report supplemental to any oral report is made) to any federal, state or local environmental agency and (ii) upon becoming aware thereof, of any inquiry, proceeding, investigation, or other action, including a notice from any agency of potential environmental liability, of or any federal, state or local environmental agency or board, that has the potential to materially affect the assets, liabilities, financial conditions or operations of the Borrower or any of its Subsidiaries, Subsidiaries or the Agent's security interests pursuant to the Security Documents.

The Borrower will promptly give notice to the Banks Administrative Agent (ia) of any violation of any Environmental Law that the Borrower or any of its Subsidiaries reports in writing or is reportable by such Person in writing (or for which any written report supplemental to any oral report is made) to any federal, state or local environmental agency and (iib) upon becoming aware thereof, of any inquiry, proceeding, investigation, or other action, including a notice from any agency of potential environmental liability, of or any federal, state or local environmental agency or board, that has the potential to materially affect the business, assets, liabilities, financial conditions or operations of the Borrower or any of its Subsidiaries, or the Administrative Agent's security interests pursuant to the Security Documents.

The Borrower will promptly give notice to the Banks Bank (i) of any violation of any Environmental Law that the Borrower or any of its Subsidiaries reports in writing or is reportable by such Person in writing (or for which any written report supplemental to any oral report is made) to any federal, state or local environmental agency and (ii) upon becoming aware thereof, of any inquiry, proceeding, investigation, or other action, including a notice from any agency of potential environmental liability, of or any federal, state or local environmental agency or board, that in either case involves the Real Estate or has the potential to materially affect the assets, liabilities, financial conditions or operations of the Borrower or any of and its SubsidiariesSubsidiaries taken as a whole, or the AgentBank's security interests pursuant to the Security Documents.

The Borrower will promptly give notice to the Banks Managing Agent (ia) of any violation of any Environmental Law that the Borrower or any of its Subsidiaries reports in writing or is reportable by such Person in writing (or for which any written report supplemental to any oral report is made) to any federal, state or local environmental agency and (iib) upon becoming aware thereof, of any inquiry, proceeding, investigation, or other action, including a notice from any agency of potential environmental liability, of or any federal, state or local environmental agency or board, that has the potential to materially affect the business, assets, liabilities, financial conditions or operations of the Borrower or any of its Subsidiaries, or the Managing Agent's security interests pursuant to the Security Documents. 9.5.3.

The Borrower will promptly give notice to the Agent and each of the Banks (ia) of any violation of any Environmental Law that the Borrower or any of its Subsidiaries reports in writing or is reportable by such Person the Borrower in writing (or for which any written report supplemental to any oral report is made) to any federal, state or local environmental agency and (iib) upon becoming aware thereof, of any inquiry, proceeding, investigation, or other action, including a notice from any agency of potential environmental liability, of any federal, state or local environmental agency or board, that has the potential is reasonably expected to materially affect the assets, liabilities, financial conditions or operations of the Borrower or any of its SubsidiariesBorrower, or the Agent's security interests pursuant to the Security Documents.
