Environmental Clearances. The Authority represents and warrants that the environmental clearances required for construction of the Project shall be procured by the Authority prior to the date of issue of LOA. For the avoidance of doubt, the present status of environmental clearances is specified in Schedule-A.9

Environmental Clearances. The Licensee shall provide to state and federal agencies all information necessary for environmental clearances and other authorizations necessary for this Project. The Licensee shall comply with the provisions, including giving notices during construction when so required. The Licensee shall not be compensated for the delays in obtaining environmental clearances and authorizations; however, an appropriate extension of time will be granted in accordance with the provisions in Article 36.15-g, Adjustment of Contract Time Due to Reasons Beyond Trustees’ Control, if the Licensee demonstrates to the satisfaction of the Trustees that it has made every reasonable effort to obtain the requisite clearance or authorizations, and cannot obtain it in a timely manner.
Environmental Clearances. The Allottee(s) is made aware that the promoter may be required to obtain new/revised/amended environmental clearances from time to time during the course of the said construction and the Allottee(s) hereby giving their irrevocable consent and/or permission to promoters for applying and obtaining such new/revised/amended Environmental Clearance Certificate in this regard.

A.4.a NEPA Requirements Environmental services will be furnished to provide a document developed in accordance with the National Environmental Policy Act of 1969, as amended and in accordance with Wyoming Department of Transportation policies and procedures and applicable Federal and/ or Wyoming State Laws, guidelines, and standards. As appropriate, the consultant will be responsible for any necessary coordination with federal, state or local/tribal agencies having regulatory or jurisdictional authority, or special interest or expertise over environmental areas of concern. The consultant will obtain all necessary National Historic Preservation Act Section 106 project clearance from the State Historic Preservation Office. As required, all necessary project public informational meetings, scoping meetings and/or public hearings will be coordinated and conducted.
