Engineering Studies. The Customer shall pay for all costs related to any studies performed or commissioned by TEP, including, but not limited to, any Feasibility Study, System Impact Study, or Facilities Study, and any re-studies of the same.

Engineering Studies. In order to achieve greater efficiency and utilization, the Company will require that all employees work to at least the established standard. Employees who fail to maintain the established average production requirements may be subject to disciplinary action in accordance with article 2:10 (a). The parties further agree that the Union will be advised in writing of the current plant average production requirements for each operation in the plant. The standards will be established through the use of Industrial Engineering studies and those activities where less than the established standard exists will be restructured to achieve the desired level. Restructuring may require machine changes, layout changes, crew changes and process or method changes. The Union recognizes the need for the Company to remain competitive. The Company will achieve its productivity objectives by ensuring that the established standard and its competitiveness in market place are met. The Company recognizes the Union’s right to challenge engineering studies by the Company, and may have studies prepared by it’s own Industrial Engineering Department. Such challenges will be subject to the grievance procedure up to, and including arbitration. Changes however, will be implemented on a timely basis and will not be delayed pending a challenge study by the Union.
Engineering Studies. The Plan of Exploration for the Oooguruk Unit incorporates current engineering work underway to meet a possible winter 2004/2005 fast track production start-up. Associated with this work is the identification of possible production synergies with the adjacent Kuparuk River Unit. The goal of the studies is to minimize costs and the environmental footprint. Conceptual engineering and collaboration with the Kuparuk River Unit are critical to expedite production. Engineering scoping and costing studies will continue through at least 2005 to allow for the timely progression of development activities.
Engineering Studies. The Developer shall retain the services of a qualified professional engineer for the design and supervision of the proposed electrical distribution system including street lighting. All works to be constructed shall be approved by Westario Power prior to their installation.
Engineering Studies. Purchasers shall have received engineering reports and studies as to the structural condition of the Improvements at each of the Acquired Facilities, which reports shall be reasonably satisfactory to Purchasers. Purchasers agree to complete such engineering studies within thirty (30) days of the date hereof. If Purchasers shall not have given written notice to Pathmark within 45 days of the date hereof (along with copies of all reports) specifying the extent to which the structural condition of the Improvements is unacceptable to Purchasers, Purchasers shall be deemed to have waived this condition. Pathmark shall have 30 days from its receipt of Purchasers' notice to notify Purchasers whether Pathmark elects to make the required repairs. If Pathmark will not make such repairs, Purchasers may terminate this Agreement with respect to the affected Acquired Facility by delivering written notice to that effect to Pathmark within 15 days of Pathmark's notice to Purchasers that Pathmark would not make the required repairs. If Purchasers do not give a timely termination notice, the Parties shall proceed to Closing (with no obligation on Pathmark or Plainbridge to repair any structural defects) without any adjustment to the Purchase Price.
Engineering Studies. The Participant shall assist the DOE in engineering studies to be conducted by the Department and/or its contractors with respect to waste removal, site restoration and other related project matters, by providing the services of its employees and consultants, for reasonable periods of time and upon reasonable notice, at no cost to the Department.
Engineering Studies. Copies of all engineer reports, engineering contracts, land planning maps, soils tests, drainage studies, traffic studies, erosion control plans, landscaping plans, and other documents prepared and existing for the New Construction to be completed at the Project, available at Closing, with subsequent submissions to the Buyer of reports and studies not required to be available at Closing, if requested by Buyer.

Engineering Studies. Buyer is hereby authorized to conduct such tests, environmental tests and studies and engineering studies as Buyer deems necessary with respect to the Property prior to Closing. For such purposes, Xxxxx and Buyer’s agents, employees and contractors shall have the right, pending the Closing, to go upon the Property at reasonable times, in reasonable frequency and after twenty-four hours' prior notice (which may be verbal) to Xxx Xxxxxx (telephone no. 000-000-0000). Seller may impose reasonable restrictions on the timing of such inspections and reviews. The costs of such tests and studies shall be paid by Xxxxx. Buyer shall provide to Seller copies of all reports and information resulting from such inspections, investigations and studies including, but not limited to, all environmental site assessments, investigations or studies of the Property with respect to hazardous substances or other environmental matters. Buyer shall keep the Property free and clear of any mechanic’s or materialmen’s liens arising out of any such entry and/or inspection conducted by Buyer or its representatives. Notwithstanding any general liability or other insurance that may be maintained by Buyer, Buyer shall indemnify and defend Seller, and hold Seller harmless (using counsel reasonably satisfactory to Seller) from any and all loss, cost, liability, claim, damage, or expense (including, without limitation, reasonable legal fees and costs) that Seller may sustain or incur by reason of or in connection with any entry and/or inspections by Buyer or its representatives. Additionally, Buyer shall promptly repair any damage to the Property occurring as a result of such inspections or investigations and, if Buyer or its representatives undertake any borings or other disturbances of the soil, Buyer shall cause the soil to be re-compacted to its condition immediately before any such borings or other disturbances were undertaken. The indemnification and repair provisions of this Section shall survive the Closing or termination of this Agreement and Buyer shall not have any right to return of the Xxxxxxx Money unless and until all such damage is repaired. If no inspections, tests, and/or studies are performed regarding all or part of the Property, Buyer is bound by whatever information such inspections, tests and/or studies would have revealed, and waives any claim, right or cause of action relating to or arising from any condition of the Property that would have been revealed had such inspe...
Engineering Studies. The Owner and Consulting Engineer shall undertake sufficient engineering studies, including drainage and soil investigations, to ensure that the proposed municipal works and services are compatible with existing site and servicing constraints and can be carried out in a manner which would satisfy all City standards and conform with good engineering practice.
