Engineering Review. Each Service Order submitted by Customer shall be subject to an engineering review by Comcast. The engineering review will determine whether the cable plant must be extended, built or upgraded in order to provide the ordered Services at the requested Service Location(s), or whether Service installation has to be expedited to meet the Customer’s requested Service Commencement Date (”Custom Installation”) . Comcast will provide Customer written notification in the event Service installation at any Service Location will require an additional one-time installation fee (“Custom Installation Fee”). Customer will have five (5) days from receipt of such notice to reject the Custom Installation Fee and terminate, without further liability, the Service Order with respect to the affected Service Location(s).

Engineering Review. The design, construction, and specification of material and equipment to be used in all the Facilities installed by Grantee shall be subject to approval and construction observation by the Town’s designated and qualified agent and/or consulting engineer whose decision shall be final as to any question arising regarding the same. Grantee shall contract directly with the Town’s consulting engineer to review the plans for the design of said Facilities whose approval of the design, location, and specification for all materials and equipment shall be required prior to the commencement of construction and which will be in substantial compliance as to location as set forth on Exhibit “A” attached hereto and incorporated by reference herein. The decision of the Town’s consulting engineer shall be final as to any question arising regarding the design, construction, or specification of material and equipment to be used in the construction of said Facilities. The cost for review of the design, construction, and specification of material and equipment to be used in the construction of the Facilities shall be in accordance with the schedule of charges for such review and construction observation fees as posted on the McCordsville website (xxx.xxxxxxxxxxxx.xxx) at the time of each submitted section. Grantee shall be responsible for any such design review and/or construction observation fees or any other cost in connection with such inspection and approvals.

For certain Services, the Engineering Review will be conducted prior to Sales Order submission. Secarus will provide Client written notification in the event Service installation at any Service Location will require an additional one-time installation fee (“Custom Installation Fee”). Client will have five (5) days from receipt of such notice to reject the Custom Installation Fee and terminate, without further liability, the Service Order with respect to the affected Service Location(s).

Customer will have five (5) business days from receipt of such notice to reject the one time Installation Fee and terminate, without further liability, the Service Order with respect to the affected Service Location(s). In the event Customer does terminate pursuant to this section, then Customer shall be responsible for reimbursing Clear Rate for all out of pocket expenses incurred in connection with the anticipated project which were incurred after the effective date of the Agreement.
